Indeed, it is outrageous that PAS spiritual leader Hashim Jasin (above) should say that the Minister of Plantation Industries and Commodities, Mohd Khairuddin Aman, who violated the mandatory 14-day quarantine order for all returnees, was not at fault, the fault should be with the Ministry of Health and the Ministry of Foreign Relations for failing to ensure the minister complied with the request after returning from Turkey on July 7.
Even Islamic criminal law is based on the principle of individual responsibility. A person is punished for her own actions. But there are circumstances in which a person who has committed a crime is not responsible for the consequences.
Some of these circumstances are related to mens rea – the guilty mind – or the absence of it. For example, when the crime was committed by a minor or a madman.
Real men an offender is charged if he or she:
1. He had the power to commit or not commit the act – Muslim jurists call this what;
2. He knew that the act was a crime; and
3. Acted with intention (revenge).
That is why minors and crazy people are not held responsible for their crimes because it is presumed that they did not know the illegality of their acts. They also lack criminal intent.
It cannot be presumed that the minister lacks criminal knowledge and intent. Therefore, you are personally responsible for your act of violating the mandatory quarantine order.
Malays have a saying, dare to do, dare to endure.
