Kuantan Court grants stay of enforcement action against illegal durian farms in Raub

KUANTAN: The Kuantan High Court has granted a stay of enforcement of actions against the illegal durian farms in Raub.

Attorney Siew Choon Jern, who represented 111 durian planters, said they have filed a request for judicial review on decisions to lease the plantation land to a joint venture and evict the planters.

“The Attorney General needs time to review our application and affidavits. We have no objection, as it is only fair that they have some time to read it.

“At the same time, we request the suspension of the decisions of the authorities, especially the order to evict the durian planters from the land.

“The Attorney General’s Office and the court have no objections after hearing a short presentation, so the judge allowed the suspension until the next hearing date on October 28,” Siew told reporters here on Friday (August 28) .

The applicants had named the Raub District Land Administrator, the Director of the State Department of Forestry, State Authorities, State Government, Perbadanan Kemajuan Pertanian Negeri Pahang and Royal Pahang Durian Resources PKPP Sdn Bhd as respondents in their application.

Among others, the plaintiffs are seeking a judicial review of notices issued to evict them from the lands in Sungai Ruan, Sungai Chalit, Sungai Klau, Tranum, Tras and the Gunung Benom forest reserve or its surroundings.

The applicants also want a judicial review on the state government’s decision to grant a lease and use rights of 2,167.9 hectares of land in Raub to Royal Pahang Durian Resources PKPP Sdn Bhd for a period of 30 plus 30 years, as well as the mandatory requirement that they sell their durians to an entity designated by the joint venture.

The main federal lawyer Noor Fadzila Ishak represented the Attorney General’s Office in the process chaired by Judge Zainal Azman Ab Aziz.
