KL Court orders DAP chief Batu Kitang to pay professor RM8 thousand for defamation

KUCHING (24 November): A High Court in Kuala Lumpur ordered DAP Batu Kitang Chairman Abdul Aziz Isa Marindo to pay Professor Kamarul Zaman Yusoff of Universiti Utara Malaysia RM8 million in defamation damages.

According to the November 6 sentencing order, which was seen by The Borneo Post, the sentence against Aziz Isa, who is special assistant to DAP Sarawak President Chong Chieng Jen, was approved after he failed to appear in court for the demand.

The court also ordered RM10,000 in costs in addition to various default interest, including four percent annual interest on the amount of the default judgment until full settlement.

In addition, the court granted Kamarul Zaman a court order to prevent Aziz Isa, his agents or staff, among others, from republishing the defamatory comments.

The defamatory comments were detailed in the claim statement dated July 28, 2020, and the order said that Aziz Isa was required to also declare those comments to be false.

Kamarul Zaman had sued Aziz Isa for comments he had made on a Facebook post in June 2017.

In a press release today, Aziz Isa said that he has consulted his lawyers to file a request to set aside the default judgment handed down on him by the Kuala Lumpur High Court.

He claimed that he never received the Writ of Summons and Statement of Claims issued by Kamarul Zaman’s attorneys.

“Second, I only learned of the ruling through social media when the plaintiff posted on his Facebook account the news that the High Court of Malaya had handed down a default ruling on me dated November 6, 2020.

“The publication was made by the claimant on November 23, 2020,” it said.
