Gombak voters sue Azmin for deception and breach of fiduciary duty

KUALA LUMPUR: Ten Gombak voters have filed a lawsuit for deception and breach of fiduciary duty against their MP, Mohamed Azmin Ali, nine months after the “Sheraton Motion” that led to the collapse of the Pakatan Harapan (PH) government.

The plaintiffs want a statement that the chief finance minister, as trustee, owes them a fiduciary duty as an elected representative.

In the lawsuit filed by Messrs. Yohendra Nadarajan in Superior Court last week, the plaintiffs also want a statement that Azmin committed the crime of deception against them.

They also want a statement that Azmin violated his constitutional oath under Article 59 (1) read in conjunction with Schedule 6 of the Federal Constitution.

Plaintiffs also seek damages and other orders that the court deems appropriate.

In his claim statement seen by FMT, the bone of contention for the plaintiffs is that Azmin made a statement that he was running for election in 2018 to overthrow the then Barisan Nasional (BN) coalition and rid Malaysia of corrupt officials. .

They said Azmin caused the collapse of the PH government in February and joined the Perikatan Nasional administration, which included the BN, which included people that Azmin himself had acknowledged were “credibly accused of corrupt practices.”

The plaintiffs said Azmin, the former vice president of PKR, had committed to complying with the PH 2018 election manifesto, to address, among others, BN’s crimes when it was the federal government.

They also said that Azmin announced on his Facebook page on April 27, 2018 that the XIV general election was important so that people could inherit responsible and responsible leadership.

In one of their campaign rounds, they said Azmin told voters that they should vote for PKR to ensure a competent and stable government.

“He also said that his enemies were those who supported the then prime minister, Najib Razak, Umno and BN. He called those supporters traitors, ”they said.

Furthermore, they said, Azmin represented that he would remain at PKR and PH to ensure that the promises in the manifesto would be kept if they formed the government.

On February 23, there was a change of government in which some leaders of BN, PAS, PPBM and PKR, including Azmin, gathered at the Sheraton Hotel in Petaling Jaya, resulting in the resignation of Prime Minister Dr. Mahathir Mohamad.

Azmin and several other PKR MPs were among the central figures in the political crisis that culminated in a seizure of power.

PPBM President Muhyiddin Yassin was appointed Prime Minister on March 1, and Azmin, who has been appointed to the Supreme Council of PPBM, was subsequently appointed Minister.
