Former deputy Nasharudin discharged that does not amount to acquittal of 16 CBT charges

PETALING JAYA: Former PAS Vice President Nasharudin Mat Isa received a discharge that does not amount to an acquittal (DNAA) of 16 counts of criminal breach of trust (CBT) when he was president of the Nassar Foundation.

However, he will face trial on 17 counts of CBT and money laundering involving RM3.65 million.

Shah Alam Session Court Judge Rozilah Salleh allowed the DNAA on September 22 after the prosecution informed her that the Attorney General’s Office (AGC) had partially accepted the representation made by the defendant’s attorney.

Deputy District Attorney Mohd Zaki Salleh, who is in charge of the prosecution, confirmed the DNAA. The DNAA still gives the prosecution the discretion to re-file charges later if they can gather credible evidence to prove their cases.

The 16 CBT charges were for dishonestly accepting RM321,273.80 in total as salary for being president of the Nassar Foundation between 2015 and 2018.

Zaki said another 17 CBTs and three counts of money laundering against the defendants would proceed. Case management will be held on November 20 to set trial dates.

On October 19 last year, the former deputy of Yan and Bachok claimed judgment on 33 counts of money laundering and CBT in the amount of RM4 million.

Three of the charges corresponded to the Law against money laundering, terrorist financing and the proceeds of illicit activities for money laundering worth CU302,069.60

The remaining 30 charges were under Section 409 of the Penal Code for committing CBT that involved RM3,721,683.80 between 2015 and 2018.

Nasharudin was vice president of the PAS from 2005 to 2013. He was fired from the Islamist party for statements critical of the party and for being absent from meetings.

He became close to Najib Razak long before the union of Umno and PAS, and had accompanied the former prime minister on his visit to Gaza in Palestine.
