Fine of 10,000 ringgit against assailants staying on the road after the prosecution withdraws the appeal

A video recording of Danial Abdullah Tan smashing the car’s windshield went viral on social media in May 2019.

PUTRAJAYA: The Court of Appeal today confirmed a fine of 10,000 ringgit imposed by the High Court on a road thug known as “Abang Botak” for smashing the front windshield of a car with his protective helmet after the prosecution withdrew his appeal .

The prosecution had appealed against the fine of 10,000 ringgit imposed by the High Court against Danial Abdullah Tan, 33, who was initially sentenced to 12 years in prison for the crime by the Petaling Jaya Magistrates Court.

A three-judge panel, led by Abdul Karim Abdul Jalil, dismissed the appeal after Deputy Prosecutor Faizah Mohd Salleh informed the court that he had submitted a notice to withdraw it on November 17.

Attorney Azura Alias, representing Danial, did not object.

The other two judges on the panel were Lee Swee Seng and Supang Lian.

On January 20 last year, the Shah Alam High Court allowed an appeal from Daniel to overturn the 12-year jail sentence imposed by the Magistrates Court on May 31, 2019 and replaced it with a fine of RM10,000, by default 12 years in prison.

Danial, then a store assistant, who had pleaded guilty to the charge, paid the fine.

He was charged with mischief by breaking the front windshield of a car belonging to Siew Chean Voon, 60, with his helmet, causing losses of approximately RM600, at Jalan Kasturi in Taman Bukit Serdang, Seri Kembangan, around here at 5.30. May pm. 28.

Danial had told the court that he was riding his motorcycle when the car nearly collided with him, adding that he smashed the windshield in anger when Siew pointed it out.

The incident was recorded by Siew’s dash cam and the recording went viral on social media.
