Driving while drugged: Six years in jail, fine of RM11K for the woman who killed a Naval officer in an accident

JOHOR BARU: A 23-year-old woman was sentenced to six years and seven months in prison and a fine of RM11,300 in Magistrates Court here for driving under the influence of drugs and causing the death of a Naval officer.

The defendant, Nur Fatin Nasrah Suhaimi, pleaded guilty to the five charges that were read to her in two different courts before Judges Suhaila Shafi’uddin and R. Salini.

His right to have a driver’s license was also revoked for six years.

According to the charge sheet in the first court, the defendant was driving a car under the influence of drugs, which caused her to lose control of the vehicle and led to the death of another driver, 31-year-old Mohd Rizal Buseri.

The act is an offense under section 44 (1) (a) of the Highway and Transportation Act 1987 for driving under the influence of drugs and provides a prison term of between three and ten years and a fine of between 8,000 and 20,000 ringgit. .

The offense took place at 8.24 am at the KM4 Jalan Johor Baru-Kota Tinggi stoplight on October 10 (Saturday).

The defendant was also charged under Section 26 (1), Section 15 (1), and Section 90 (1) of the Transportation and Highways Act of 1987 for driving without a license, driving a vehicle without road tax, and driving without insurance.

Meanwhile, in a separate courtroom, the defendant was also charged under section 15 (1) (a) of the Dangerous Drugs Act of 1952 for testing positive for methamphetamine and amphetamine.

The law provides for a fine not to exceed RM 5,000 or a jail term not to exceed two years, and is subject to the supervision of a correctional officer for not less than two years and a maximum of three years.

The prosecution was led by Deputy Prosecutor Tengku Amir Zaki Tengku Abdul Rahman and Noridayu Md Kassim, while the accused was not represented.

Nur Fatin Nasrah, in her guilty plea, said she regretted what she had done and apologized to the victim’s family.

She added that she was currently caring for two younger siblings and their parents.

However, Tengku Amir Zaki, in his argument, said that the court must uphold the public interest and send a message that severe action will be taken for the crime.

Judge Suhaila sentenced the defendant to six years in prison, fined her RM8,000 with a guarantee and revoked her right to have a driving license for five years.

She was also fined RM 3,300 for the offense under Section 26 (1), Section 15 (1) and Section 90 (1) of the same law and the rights to have her driver’s license revoked by a additional year.

Meanwhile, Judge Salini sentenced the defendant to seven months in prison and two months of supervision by the National Anti-Drug Agency (AADK) for the crime contemplated in Section 15 (1) (a) of the Dangerous Drugs Act of 1952.
