KUALA LUMPUR: Former Prime Minister Tun Dr. Mahathir Mohamad has denied any abuse of power over the termination of Tan Sri Mohamed Apandi Ali as attorney general in 2018.
This was stated in the defense statement presented by Dr. Mahathir and the Federal Government as first and second defendants, respectively, in a 2.2 thousand RM lawsuit filed against them by Apandi.
The defense statement was signed by the Superior Federal Legal Advisor of the Attorney General’s Office and presented on Thursday (November 12).
In the statement, which was seen by The Star, the defendants said that the termination of Apandi’s contract as legal officer was legal and adhered to legal provisions.
The defendants further stated that there was nothing in the plaintiff’s allegation that would make the plaintiff worthy of exemplary or punitive damages.
They said that in any situation, the plaintiff was not entitled to the relief he prayed for.
They also said that the plaintiff’s claim was without merit and a misrepresentation of the law.
“We humbly pray that the plaintiff’s claims will be dismissed at cost,” he said.
The case was filed for online case management with Deputy High Court Registrar Norhatini Abd Hamid on Friday (November 13).
A check on the electronic filing system showed that the case has been settled for further case management through electronic review on December 3.
On October 13, Apandi filed the lawsuit against Dr. Mahathir and the government for a statement that his dismissal as attorney general two years ago was illegal.
In its statement of claim, Apandi seeks, among others, a statement that the first defendant had committed a crime and misconduct in public office and a statement that the first defendant had caused and induced the breach of the contract between him and government.
The former Federal Court judge also requests that it be declared that there was a breach of article 145 of the Federal Constitution regarding his dismissal and that his dismissal as attorney general was not in accordance with the law and, therefore, illegal.
He requests special damages in the amount of 2,233,599.36 ringgit, general damages, exemplary and / or punitive damages, costs and other reparations that the court deems appropriate.
