Cradle Fund murder trial: 29th witness statement merely as hearsay evidence, defense says

SHAH ALAM (Bernama): The defense in the murder trial of Cradle Fund CEO Nazrin Hassan told the High Court here that the 29th prosecution witness’s statement can be described as mere hearsay evidence.

The witness, Eliza Elias, 44, who is also from Cradle Fund Sdn Bhd

Vice President (Marketing and Ecosystem Development), read the witness statement before Judge Datuk Ab Karim Ab Rahman.

Lawyer Tan Sri Muhammad Shafee Abdullah in his argument said that the evidence presented by Eliza through her witness statement was also considered unrelated to the murder case.

According to paragraph nine (in the witness statement), she said that Nazrin told her that there were items in her house that were bought abroad, an iPad and a laptop, that were damaged. Nazrin told him what had happened.

The witness said (through her testimonial statement) that she did not know of any developments on the issue.

“In paragraph seven, the witness stated that Nazrin’s son had spent the night at Nazrin’s house, but he did not like the house. He was there because he did not want to offend Nazrin.

“These events (as stated in a witness statement) have nothing to do with the case (Nazrin’s murder). They are also unrelated (to that case). I don’t see what they have to do with (the case). She obviously heard it from Nazrin or her son, ”he said.

Muhammad Shafee said that Eliza through her witness statement also stated that Nazrin had told her that she had used her salary to pay rent, children’s expenses and credit cards that were not related to the murder case.

“If I cross-examine, the witness can say that (the information in her witness statement) is what Nazrin had told her,” he said.

In her statement, Eliza, among others, also stated that she had known Nazrin since 2006, and that they had worked together at a company before joining the Cradle Fund.

He also claimed that his former employer was not a short-tempered person but was firm and mentioned Nazrin’s married life.

Deputy Prosecutor Mohd Asnawi Abu Hanipah in his argument defended the witness’s statement by saying that all the evidence was factual to what Nazrin had told Eliza, other than to show the relationship between the two.

“These are facts that the witness said was told by Nazrin. It is also about the relationship between Nazrin and the people in his home. It is direct evidence. The court can accept these facts depending on other evidence,” he said.

Later, Judge Ab Karim ordered that the witness’s additional evidence be temporarily postponed for the defense to present an objection to the court against her statement.

On March 12, 2019, Nazrin’s wife, Samirah Muzaffar, 45, a former senior executive of the Malaysian Intellectual Property Corporation, and two teenagers, 17 and 14, along with an Indonesian, Eka Wahyu Lestari, still a fugitive, they were charged with the murder of Nazrin. .

They were accused of committing the act in a house in Mutiara Damansara between 11:30 p.m. on June 13 and 4 a.m. on June 14, 2018.
