KUALA LUMPUR: The trial of two former directors of Silver Bird Group Berhad will continue after the Court of Sessions today dismissed their request to drop 15 charges for allegedly providing Bursa Malaysia Securities Berhad (Bursa Malaysia) with false statements.
Judge Hasbullah Adam made the decision after finding no basis in the request filed by Datuk Tan Han Kook, 66, and Ching Siew Cheong, 53.
“After reviewing and considering the application, I cannot find sufficient merit in the application. Therefore, the application is rejected ”, said the judge.
Hasbullah said the rights of both applicants would not be impaired as they still have a chance to challenge the evidence after the prosecution closes the case.
Then he set December 16 and 17 for the continuation of the trial.
Deputy Prosecutor Mohd Hafiz Mohd Yusof of the Malaysian Securities Commission (SC) told the court that the prosecution would call five or six new witnesses after a total of 34 prosecution witnesses were called to testify in this case.
Ching was represented by attorney Datuk N. Sivananthan, while attorney Teh See Khoon represented Tan.
On September 11, 2013, Tan and Ching pleaded not guilty to seven and eight counts, respectively read separately before the Judge of the Court of Sessions, Murtazadi Amran.
Both were charged with knowingly allowing the supply of false statements to Bursa Malaysia Securities Berhad, which were the condensed consolidated income statements for the three-month period ending January 31, 2010, and October 31, 2011 .
They are charged with committing the crime at the Bukit Kewangan Stock Exchange Office between March 29, 2010 and December 31, 2011.
Both Tan and Ching face a maximum of 10 years in jail and a fine of up to RM3 million if convicted of offenses under Section 369 (b) (B) of the Capital Markets and Services Act 2007. – Called
