JOHOR BARU: The 41-year-old president of a cooperative was sentenced to eight years in prison and two strokes of the baton by the Session Court here on two counts of criminal breach of trust (CBT) in the amount of RM300,000 in September this year.
Alan Lim Boon Siong pleaded guilty to the charge that was read to him in front of Judge Aizatul Akmal Maharani.
According to the charge sheet, the accused held the position of president of Koperasi Peladang Jaya Pekan Nanas and abused his position, in addition to misappropriating a fund that belonged to the cooperative to his personal account.
In the first count, the defendant had allegedly transferred funds belonging to the company amounting to RM 100,000 to his personal account at a bank in Pekan Nanas on 1 September.
As for the second charge, he had allegedly transferred a sum of RM200,000 belonging to the cooperative to the same account at the same bank on September 7.
The act is a crime under Section 409 of the Penal Code for committing criminal breach of trust that carries a jail term of up to 20 years with possible whipping and a fine upon conviction of each count.
In his guilty plea, Lim, who has held the position for five years, requested a lighter prison sentence as he cares for his wife and two elderly parents.
Lim was not represented while Assistant District Attorney Chai Ing Hien was indicted.
In response, Chai requested a more severe punishment due to the dishonest actions of the defendants.
The court then sentenced Lim to a sentence of four years in jail and a baton stroke for the first count, and another four years in prison and another baton strike on the second count.
Both phrases will be executed consecutively.
