SHAH ALAM: A director of a mobile accessories company was fined RM30,000 in one month in jail by the Court of Sessions here today for possessing TV media boxes containing software to illegally obtain the content of the television channel paid over the internet.
Judge Muhamad Anas Mahadzir sentenced 46-year-old Ng Lee Lee after he pleaded guilty to all six counts.
In his opinion, Anas said that the defendant’s act of selling the television media boxes was a form of piracy by taking shortcuts and benefiting from the hard work of other people.
“The court appreciates honesty and a guilty plea, but what is wrong is wrong because it is a very serious crime,” he said.
Ng is the first person convicted under section 232 of the Communications and Multimedia Act 1998, which provides for a fine not to exceed RM300,000 or a prison term of up to three years, or both, if convicted.
According to the charges, Ng was charged with possessing six iBoite-X media boxes containing MyTV.apk software in order to improperly obtain the content application service provided by Measat Broadcast Network System Sdn Bhd, also known as Astro.
The crimes were allegedly committed in Taman Putra Prima, Puchong at around 2.30pm on December 12, 2019.
Earlier, Deputy Prosecutor Syazwani Zawawi offered a fine of RM30,000 for each count after taking into account the interest of the public, content creators and creative content, as the defendant’s act had caused the government to lose revenue through of taxes.
In mitigation, attorney Low Li Qun, who represented the defendants, said this was her client’s first offense, in addition to having to take care of her sick parents and three children.
