KUALA LUMPUR (Bernama): The arrest warrant for Datuk Azwanddin Hamzah (Photo), who had not previously attended the judicial process brought against him by former Minister of Primary Industries Teresa Kok, has been overturned by the Superior Court here on Friday (September 25).

Judge Datin Rohani Ismail canceled the order after Pertubuhan President Jaringan Melayu Malaysia (JMM) appeared in proceedings on Friday.

Kok’s lawyer, Datuk Sankara Nair, told reporters that, with Azwanddin present, they withdrew the request for legal proceedings against him that was filed on October 8 last year.

“The judge would lock him up if he did not appear today. So, since he came to court, we withdrew the request from the internment process, but we are free to resubmit it,” said the lawyer after the matter came before Judge Rohani . in cameras.

Azwanddin was not represented.

The arrest warrant was issued by Judge Rohani against him on August 28.

The request for judicial process against Azwanddin was filed after he failed to file an open apology in three newspapers, namely Sinar Harian, The Star and Sin Chew Daily and did not pay the costs, which were among the terms of the settlement for the lawsuit. for defamation filed by Kok Against him.

However, Sankara said they filed a bankruptcy petition against Azwanddin as he has not yet made the settlement payment.

“No payment has yet been made within the reasonable time and he (Azwanddin) said he had some problems (making the settlement payment), so we told him we could consider it, but within a reasonable time.

“That is why we have decided to take the second route by filing the bankruptcy petition in July, and the hearing is set for November 16 at Shah Alam High Court. He (Azwanddin) must appear and file an application. object to the request, “he said.

Kok had filed the defamation lawsuit against Azwanddin for linking it to a land dispute involving the Sri Maha Mariamman Hindu Temple in Seafield, Subang Jaya and the case was amicably settled in High Court on July 29 last and Rohani recorded the terms of the agreement. Bernama
