Army Officer, Former Brigadier General Charged With Over RM920,000 CBT

KUALA LUMPUR: An army officer and a retired brigadier general are claiming trial in Sessions Court here for eight counts of criminal breach of trust (CBT) involving RM920,000 in welfare funds belonging to a military training academy.

Azman Mohamad Yasi, Lieutenant Colonel and retired Brigadier General Mohamad Adkaa Solahuddin were charged under article 409 of the Penal Code.

They were charged with approving RM920,000 from the welfare fund to be invested in an unregistered financial institution.

Alternatively, they were charged with dishonest misappropriation of the same sum for the same “investment” purpose, under Section 403 of the Penal Code.

The crimes allegedly took place between August 3, 2016 and September 23, 2016 at the academy in Sungai Besi here.

If convicted under Section 409, Azman and Adkaa face a jail term of two years to 20 years, as well as a fine and flogging.

Section 403 carries a jail term of between two and five years, as well as a fine and flogging, upon conviction.

Judge Mahyon Talib granted Azman and Adkaa bail of RM80,000 each on bail.

She allowed Adkaa to clear the bail amount before December 7, after her lawyer, Nor Asyikin Zakaria, said that only RM 15,000 can be raised today.

Deputy Public Prosecutor Nurshafini Mustafha had previously asked the court to post a bond of RM 100,000.

But Azman’s lawyer, Mohd Amir Aizat Abdul Rani, told the court that the amount was excessive. He said his client was also on trial in military court on charges related to this case.

Mahyon also ordered both men to hand over their passports to the court until the case was resolved and to report to the nearest Malaysian Anti-Corruption Commission (MACC) office every month.

The court set December 22 for the mention of the case.
