Appeal of 33 people, including Sabah CM, on the dissolution of the state assembly withdrawn

KOTA KINABALU: The appeal of 33 people, including Chief Minister Datuk Seri Hajiji Noor (Photo) against the dissolution of the Sabah assembly in July this year has been withdrawn according to his legal advisers.

On Thursday (December 3), a suspension notice was filed in Federal Court in the case challenging the consent given by Sabah Yang di-Pertua Negeri Tun Juhar Mahiruddin to dissolve the state legislature in July this year.

Messrs. FT Ahmad & Co, Hajiji’s attorneys and 32 others confirmed that they had received instructions from Hajiji as the eighth applicant to withdraw the Notice of Motion for Authorization to Appeal to Federal Court.

“Our clients maintain their assertion that the dissolution of the state legislative assembly was incorrect both in terms of the Sabah Constitution and due to the risks of a Covid-19 outbreak.

“However, we have informed you that in light of the recent Sabah state elections and the subsequent Covid-19 outbreak, it is in the best interest of all involved if the matter is withdrawn,” said attorney Wilson Chang Khai Sim, who acts on behalf of the 33 applicants.

After the Sabah elections on September 26, many of the 33 applicants were re-elected to the Sabah state assembly or now hold positions in the state government.

Previously, the applicants were led by Tan Sri Musa Aman, who did not seek re-election at the polls.
