Appeal filed against Siti Kasim’s acquittal, says lawyer

KUALA LUMPUR: The prosecution has filed an appeal against the acquittal of the lawyer and activist Siti Kasim (Photo) from a count of obstructing an official of the Islamic Religious Department of the Federal Territory (Jawi) in the performance of his public duty during a hotel event in 2016.

Siti’s lawyer, A. Saha Deva, briefed the press on the matter after handling the case in a lawsuit brought by Siti, whose birth name is Siti Zabedah Kasim, against Jawi before Judicial Commissioner Latifah Mohd High Court Judge Tahar here on Tuesday (September 22).

“We have been informed that the appeal notice was filed on August 27.

“Therefore, the court set October 28 for the case management to know the status of the appeal,” he said.

A check with the electronic court system showed that the appeal has been arranged for reference to Undersecretary of Record Farah Azura Mohd Saad on October 5.

Regarding the civil case, Saha Deva said that her client would submit a request to amend her claim statement.

Attorney Arik Zakri Abdul Kadir appeared for Majlis Agama Islam Wilayah Persekutuan (MAIWP), who was named as one of the defendants in the lawsuit.

On April 1 of last year, Siti sued Jawi, along with MAIWP and its officers, on charges of wrongful arrest and illegal detention during their 2016 raid of a private fundraising dinner that involved transgender people presenting an issue. of beauty pageant.

In her complaint brief, Siti alleged that the actions against her amounted to illegal imprisonment, embezzlement of public office and denial of her constitutional rights to personal liberty, and that she was informed why she was detained.

He claimed to have suffered emotionally from the arrest.

On August 21, the Magistrates Court here acquitted and released Siti Kasim from the charge of obstructing Officer Jawi after finding that the prosecution had failed to establish the case under Section 186 of the Penal Code.

Magistrate Tawfiq Affandy Chin said the charge against the defendant was flawed because the form of obstruction was not specifically stated.

Siti was accused of resisting arrest by Officer Jawi Siti Nor Jihan Saleh @ Md Ghazali, 36, at a hotel here at 10.30pm on April 3, 2016.
