KUALA LUMPUR: Former Minister Tengku Adnan Tengku Mansor agreed to pay RM40.3 million to settle a lawsuit with the Inland Revenue Board (LHDN) through a joint settlement.
This is based on a draft consent order filed in the Superior Court Register here on September 30.
Lawyer S Saravana Kumar, representing Tengku Adnan, better known as Ku Nan, had told reporters on September 23 that the lawsuit was amicably settled for LHDN to recover RM57.2 million in back taxes from their client.
This means that the 40.3 million ringgit declared in the order is almost 17 million ringgit less than the amount originally requested by LHDN.
The order states that Tengku Adnan and LHDN agree to amend the additional assessment notices for the assessment years 2012 to 2017 to arrive at a figure of RM40,358,336.61.
It states that the RM 40.3 million in levies, including penalties, constitute the settlement of the tax requested by LHDN.
“Both parties will discuss the mode of payment within 45 days after the order date,” says the order.
“RM40.3 million must be paid before December 31, even if the parties cannot agree on the mode of payment.”
The order says that Tengku Adnan and LHDN also agreed to withdraw all interlocutory requests in connection with the lawsuit without a cost order.
FMT has tried to get a response from Saravana Kumar.
Last year, LHDN filed the lawsuit against Tengku Adnan, who is also Putrajaya’s deputy, to recover RM57.2 million in back taxes from 2012 to 2017.
