KUALA LUMPUR: The woman who claims to be the wife of former Cabinet Minister Tun S. Samy Vellu has filed for the second time to intervene in a lawsuit that sought to declare the latter as mentally incapacitated.
Meeriam Rosaline Edward Paul, 59, first tried to intervene in the lawsuit, filed by Samy Vellu’s son, Datuk Seri S. Vell Paari, in December last year.
She had claimed that the relevant evidence would show that Samy Vellu was mentally fit, but on September 11, the High Court dismissed the request.
Attorney RSN Rayer, who represented Meeriam, told reporters on Monday (September 28) that his client submitted a new request to intervene in the second lawsuit on September 22.
“Previously, his (Meeriam) request to intervene had been rejected by the court.
“So, she has presented again. The court set today October 8 to hear the new request, ”he said when he met after the matter arose for the management of cases in the chambers of the undersecretary of registry Idamasliza Maarof.
Attorney Tina Francis appeared for Vell Paari.
On December 2 of last year, Vell Paari, former secretary general of the MIC, filed an initial subpoena against his father to determine the latter’s mental state through an investigation under the Mental Health Act of 2001.
He named his 83-year-old father, a former works minister, as the sole defendant.
Samy Vellu’s only son requested an investigation under section 52 of the Mental Health Act 2001 to determine whether his father suffered from a mental disorder that would render him incapable of managing his affairs.
On December 17, 2019, Meeriam filed a request to intervene in Vell Paari’s lawsuit.
In a separate lawsuit filed in Ipoh in March last year, Meeriam applied for an interim order to have unrestricted access to Samy Vellu and also to receive alimony of RM25,000 pending the outcome of his main lawsuit.
However, the hearing on the interim order was postponed by a request from Vell Paari’s legal team as the lawsuit sought to declare his father mentally incapacitated.
Meeriam claimed that she and Samy Vellu had a traditional marriage in Kuala Lumpur in 1981.
She said they had no children together.
