Three acquitted of murder of man at gas station

JOHOR BARU: Three men escaped from the gallows after the Supreme Court found them innocent of the murder of a man at a gas station.

The court ruled that the prosecution had not proven a prima facie case against Gan Jia Ji, 22, Yip Kah Hou, 26, and Woon Kian Hui, 25.

According to the charge sheet, Gan and five other suspects who are still at large allegedly murdered Tan Aik Chai, 44, at a gas station along Jalan Sri Pelangi in Taman Pelangi here at around 7:30 p.m. on 17 December 2017.

He was charged under article 302 of the Penal Code, which imposes the mandatory death penalty upon conviction.

Yip and Woon were accused of being complicit in the murder along with two other people who remain at large.

Both were charged under article 302 of the Penal Code read in conjunction with article 109 and article 34 of the same law, which carries the mandatory death penalty upon conviction.

In giving her decision, Judicial Commissioner Dr. Shahnaz Sulaiman said that witnesses at the gas station were unable to identify the defendant as the closed circuit television (CCTV) images were blurred.

“The DNA tests that were taken did not match the blood sample taken at the scene. Furthermore, no investigations were carried out into the alibi.

“The prosecution also failed to link a white BMW car to the murder,” he said before acquitting and firing the three.
