The Court of Appeal confirms the prison sentence of a retiree for outraging the modesty of a neighbor’s daughter

PUTRAJAYA (Bernama): The Court of Appeals here on Tuesday (September 1) upheld the one-year prison sentence handed down to a 72-year-old man for outraging the modesty of his neighbor’s daughter.

A three-member panel consisting of Judges Datuk Yaacob Md Sam, Datuk P. Ravithran and Datuk Wira Ahmad Nasfy Yasin dismissed the appeal of Md Ramli Md Nurdin, a retired worker from the Department of Drainage and Irrigation.

Judge Yaacob, who chaired the panel, held that there was no merit to his appeal to justify intervention on appeal.

It affirmed Md Ramli’s conviction and prison sentence imposed by the High Court.

Md Ramli was found guilty and sentenced to one year in jail and fined RM3,500 in six months in jail by a trial court for outraging the modesty of the girl, who was then 10 years old, at a house in Taiping, Perak , at 5.30. pm on June 14, 2015.

The High Court upheld his conviction for the crime and upheld the jail sentence, but overturned the fine.

Her lawyer Kathan Maruthamuthu argued that Md Ramli’s action was simply to touch the girl’s shoulder and advise her to study hard without any intention of outraging her modesty.

He said hitting the victim’s shoulder should not be seen as an outrage on his modesty.

Kathan urged the court to overturn Md Ramli’s conviction, even though his client had served his one-year jail sentence and was released from jail earlier this year.

Deputy Prosecutor Mohd Zain Ibrahim stated that the High Court had concluded that the author, who is the father of the girl, had clearly seen what happened. – Bernama
