SHAH ALAM: The High Court ordered a couple to appear in their defense on the charge of murdering their eight-year-old son at the massage parlor where they worked three ago.
Judge Datuk Noorin Badaruddin made the decision after the court found that the prosecution had succeeded in establishing a prima facie case against the defendant, Aaron Teoh Eng Wan, 36, and his wife, En Sit Mooi, 39.
The court also ordered the couple to file their defense against another charge of abuse that resulted in injury to the victim.
The victim was beaten by her parents with a cane and a stick, Deputy Prosecutor Siti Fatimah Yahya said in her opening speech on Tuesday (December 8).
The pathologist’s testimony revealed that the boy’s cause of death was due to extensive subcutaneous and muscular hemorrhage, due to multiple blunt trauma.
The testimony of other prosecution witnesses during the trial that began in July 2019, such as the chemist, also confirmed that there was deoxyribonucleic acid (DNA) belonging to Teoh and the victim in a cane found at the scene.
CCTV footage at the premises showed En dragging the victim, who was weak and weak, several times, the court had heard.
The couple is on trial for killing the eldest of their two children at the Regalia Business Center, Subang Jaya, between 2:00 p.m. and 3:30 p.m. on May 26, 2017, according to Section 302 of the Penal Code read with Section 34 of the same Code. , which provides for the mandatory death penalty if convicted.
Teoh and En are also charged with abuse that caused harm to the victim at the same place, time and date in accordance with Section 31 (1) (a) of the Children’s Act 2001 and read with Section 31 ( 5), which is punishable under Section 31 (1) of the same Act.
They were charged for the first time in the Petaling Jaya Magistrates Court on June 5, 2017.
Attorney Tina Ong, representing Teoh, informed the court that the defense team would present two witnesses, namely the couple who decided to testify under oath on the witness stand.
En is represented by attorney Tan Teck Yew.
The court will hear the defense of the accused on January 18 and January 19 next year. – Bernama
