AMPANG: A 42-year-old man has been indicted in Session Court here with 41 counts of raping, sodomizing and sexually abusing his daughter at home since the beginning of the year.
The defendant, whose name is withheld, has pleaded not guilty after the charges were read before Session Court Judge Norhazani Hamzah on Tuesday (November 10).
He was charged with 14 counts of raping his 15-year-old daughter from his previous marriage at his home in Bukit Antarabangsa.
The crime contemplated in Section 376A of the Penal Code carries a maximum of 30 years in prison and flogging after conviction.
The man, who runs an office cleaning services company, was also charged with 18 counts of sodomy under Section 377C of the Penal Code.
The crime carries a maximum of 20 years in prison and flogging if convicted.
He was also slapped on nine counts of sexually abusing the victim under Section 14 (a) of the Sexual Offenses Against Children Act of 2017.
He faces a maximum of five years in prison and a minimum of two strokes of the baton if convicted.
All the crimes were reportedly committed in the defendant’s living room and bedroom at his home, as well as near a bush in Bukit Antarabangsa between January and October.
Deputy Prosecutor S. Sangitaa did not offer bail.
“The accused could run away and harass the victim, who is his biological daughter. As guardian, you must protect the victim and not rape your daughter as indicated in the charge sheets, ”he said.
The defendant, who was not represented, asked the court to allow him bail, saying he had to run his business and ensure the well-being of his staff.
“I ask the court to allow me bail as I also have to take care of my wife and children,” he said, referring to his current marriage.
The court did not allow bail and set December 17 for the mention of the case.
Before the case went to court, it was reported on November 6 that a businessman had been arrested for the rape of his daughter at his home here since the beginning of this year.
Ampang Jaya Police Chief, ACP, Mohamad Farouk Eshak, said the rape incident came to light after police detained the victim at Terminal Bersepadu Selatan (TBS) on November 1.
“The teenager was actually detained for attempting to leave the city, which is currently under the conditional movement control order (CMCO), without a travel permit.
“After questioning, we learned of the matter and discovered that the victim was actually trying to escape to her mother’s house in Kedah,” he told a news conference.
