An employee whose work is mobile in nature or carried out in the field, or in connection with travel or driving, will be reimbursed for the increased costs associated with the time actually worked for that type.

VDI specialists note that the amount of compensation paid for the aforementioned hours of work is mutually agreed between the employee and the employer, but the amount of compensation cannot exceed 50 percent of the basic salary (tariff) . Additionally, these allowances are paid only if the employee is not reimbursed for mission expenses.

VDI specialists recommend that the parties to the employment contract agree on the amount of compensation in the employment contract, but such amount can also be set in the employer’s workplace payment system, collective agreement, or other local regulations.

To calculate what compensation is due to a particular employee, it is calculated on the basis of the percentage of compensation specified in the employment contract or other legal acts and the working time actually worked by the employee in the field.

In determining whether work is performed in outside conditions, the nature and circumstances of each employee’s work (position) are taken into account. One of the most important criteria is the actual place of performance of the work function and the space surrounding the workplace. For example, if an employee performs a work function not indoors (in buildings) but outside the premises (buildings) where the space surrounding the workplace is opened, that work should be considered as outdoor work.

Therefore, the employer assesses the nature of the work performed by the employee, the actual circumstances of the performance of such work, and if it is established that the employee performs work functions in the field, he must pay compensation to the employee.
