One-time freeze on bank secrecy?

Attempts to rescue the criminal scrutiny of the accounts of the Banque du Liban continue by the presidencies of the Republic and the government, but none of them guarantee the change of fortune imposed by Riad Salameh, under the pretext of bank secrecy. Yesterday, the President of the Republic, General Michel Aoun, reaffirmed “the need for the government’s commitment to carry out a financial forensic audit of the Bank of Lebanon accounts”, highlighting the importance of this step in the field of reforms necessary to carry out against the financial and economic conditions of the country.

Therefore, James Daniel, head of the forensic audit team of the Alvarez y Marsal company, received Finance Minister Ghazi Wazni, Governor of the Banque du Liban, and former Minister Salim Jreissati. The circumstances that prevented the company from carrying out the criminal and financial audit of Banco del Líbano’s accounts. At the meeting it was decided “to extend the time necessary to deliver the necessary documents to the company for an additional three months, provided that during the indicated period some documents that have not yet been delivered are delivered. According to a legal study, it was found that this change in the terms does not require a modification of the contract, because it does not affect its content. Rather, it is sufficient for the Minister of Finance to send an application to do so to the company, which, as soon as he approves the application, becomes valid.

After the meeting, Wazni was asked about how to overcome the issue of bank secrecy, and he said that the opinion of the Legislation and Consultation Authority could be used in this area. Furthermore, “communication with the Banque du Liban showed increasing willingness to tackle this problem.”
The discussion moved to Serail in the afternoon. President Hassan Diab chaired a meeting which was attended by Daniel Wozni and Salameh, Ministers Zeina Aker and Marie Claude Negm, and former Minister Naji Boustany.
The meeting witnessed a heated discussion, during which Salameh reiterated that his refusal to deliver the required documents to the company was due to a problem in the contract, due to banking secrecy, and therefore must be modified because the Banque du Liban is obliged to adhere to it. On the other hand, Najm reiterated that the Banque du Liban is obliged to implement the cabinet’s decision.
In light of Salame obtaining the support of the Central Council in his effort to distinguish between the accounts of the Banque du Liban and the accounts of the Lebanese state, which he believes needs a request to lift bank secrecy, Al-Akhbar learned that the Presidency of the Government had asked Al-Bustani to prepare a bill suspending bank secrecy for once in the interests of a company. Álvarez »to conduct a forensic audit. But no one knew how such a bill would make it to the House of Representatives. Despite the possibility of an exceptional meeting of the Council of Ministers to approve the transfer of the bill to the House of Representatives, the matter has not yet been resolved. A meeting of this type puts on the table all the exceptional decisions that were signed by the presidents of the republic and the government. The answer to the question about the reason for proceeding with these decisions requires that the council be held. On the other hand, ignoring the idea of holding the session leads to the issuance of the draft by exceptional decision and to transfer it to the House of Representatives, which is expected that President Nabih Berri will not agree, given its legal violation.
After the meeting, Najm said: “The governor of the Banque du Liban must implement the government’s decision, and if he refuses, he must present an official justification to the government and public opinion on the reasons that led him to do so.” And he mentioned that “the reason for the criminal audit is that there is a great gap in the accounts of the Banque du Liban, and we want to know where the Lebanese deposits in the banks have gone.”

On the government front, yesterday, similar to the days that followed the meeting of the President of the Republic with the President-designate earlier in the week, it was outside the drafting period. There was no contact between the parties involved, amid informed sources who confirmed that the president-designate froze all consultations “perhaps pending clarity on the outcome of the US elections.”
According to monitoring sources, the main node is the node of the Ministry of Energy to which the Free Patriotic Movement adheres, in exchange for Saad Hariri’s insistence that he be a partner in the appointment. This knot caused the collapse of all previous agreements, including the rotation. After it was agreed that foreign affairs would be on the Sunni side, and interior and defense would be on the Christian side, Hariri asked for the interior again.
On the other hand, and with the strong Lebanese bloc affirming that it does not interfere in the composition, sources familiar with the author negotiations considered that the main node today is in Hariri raising the slogan “I am my name the ministers” … But, “It seems that not all ministers are exclusively Christians”, despite his prior agreement with President Aoun to leave the matter of naming them to the latter, since the Christian names he proposed “are either close to him or their relationship is not good with the current represented by the President of the Republic “, not to mention that most of the names presented” collide with the idea of jurisdiction, either in terms of the lack of competence of some ministers with the bags that called them, or in terms of combining unrelated bags that you collect.

Hariri has no Shiite or Druze names, does not reveal Sunni names, and asks the president to reach an understanding with him on Christian names.

According to the information, Hariri asked Aoun in their last meeting that an employee of the company “Booz Allen Hamilton”, Charles Hajj, take over the Interior portfolio, after he had previously appointed Nicolas Haber to this ministry. He also appointed the director of the Maronite Foundation for Expansion, Charles George Al-Hajj, to take over another portfolio, noting that he had proposed the name of the head of Bank Audi’s renewable energy department, Carol Ayat, to take over the energy portfolio. The sources reported that the President of the Republic asked the designated president for the rest of the names, and he replied that the Shiites did not yet exist, and the same occurs with the name that the former representative Suleiman Franjieh will present. The sources added that the list of names presented by Hariri included a Druze close to former MP Walid Jumblatt, while all Sunni names are “from his group” and “some of them appointed him to positions in the state.”
Sources accuse Hariri of trying to turn the clock back until before 2005, when active Christian forces had no say in the appointment of Christian ministers. She asked: What right does Hariri want to participate in the appointment of all Christian ministers, excluding ministers from other sects? He has no Shiite or Druze names and he refuses to release Sunni names, but asks the president to reach an understanding with him about Christian names.
The source says that the so-called Christian knot in fact expresses the desire of some to evoke Rustam Ghazali. He adds: No one can go beyond the constitutional stipulation that the president is a co-author and not a mailbox, as is the case with transfer. Consequently, it is no longer acceptable to call the constitutional authority the president enjoys the “Christian knot.”
