Faten Hajj wrote in the newspaper “Al-Akhbar”:
The Association of Official Teachers of Secondary Education should have finalized, at that time, the elections of the representatives of the teachers of the Association, and be in the process of preparing for the elections for the governing body for a new term (2021-2023 ), had it not been for “smuggling” amendments to the statute according to which the association raised the mandate. The body from two to three years.
That day, the League “surveyed” teachers about the amendments, in particular increasing their tenure, not allowing trained secondary teachers to participate in elections until 3 years after their confirmation, increasing the number of branches to 8 instead of 6, and creating a body for cooperative employee affairs.
The amendments encountered objections among trade union teachers, especially the independent trade union movement, which confirmed that it would not recognize an administrative body that “constitutes a legal cover for fraud and is derived from amendments whose results contradict the internal system that requires an absolute majority (half plus one) of the general assembly ”, that is, the total number of Institute teachers. Secondary Union Board member Hassan Mazloum, in his capacity as a reporter for the Bekaa branch at the time, submitted a letter questioning the results of the vote on the amendments to the former Minister of Education, Marwan Hamadeh (Minister of Guardianship of the league). From what is expressed in the book, “The number of supporters, according to the association’s numbers, is 2,221 out of 4,889 teachers, or 45.4 percent, in contravention of article 49 of the statute that establishes that the reform requires approval. of the absolute majority of the General Assembly. The League based its decision on the approval of 85% of the voting participants (184 high schools and units), while it needed about 250 additional teachers to pass the amendments in order to be legalized.
As a result of this appeal, the elections for the previous session of the Association’s Board of Directors (2019-2021) were held in January 2019 in accordance with the old statute stipulating the two-year term, after Hamadeh request that the amendments not be carried out pending an opinion from the Legislation and Consultation Commission of the Ministry of Justice. Regarding the legality of the modifications. Each of the resources presented, Hassan Mazloum, and the director of the Association of Teachers of Secondary Education, Nazih Jabawi, were informed of this.
On March 14, 2019, the Legislative and Consultative Commission issued an opinion, which approved the legality of the amendments approved by 2,221 of the 2,668 teachers who attended the sessions in which the amendments were voted, noting that the number of invited vote (the General Assembly) was 4,889 teachers. Following the issuance of the advisory opinion, former Minister of Education Akram Shuhayb requested that both Mazloum and Jabawi be notified.
According to Djibawi, the League relied on the advice not to hold elections this year. While Jabawi confirmed that the Ministry of Education informed Mazloum through his secondary school (Official Bednayel Secondary School) of the opinion of the legislative authority at the time of its issuance, the latter denied having been informed of this opinion to date. He said that “a trap was set for us not to appeal the decision to the Council of State,” blaming the Ministry of Education and the League “for the responsibility of depriving us of this right.”
Mazloum referred to a political tutelage over the Legislation and Consultation Commission of the same political team present in the League, saying: “We are facing an illegal association that has an impersonal nature and is present by virtue of a political decision and not by legal decision. and union, and its members for us have become classmates from high school and are not members of a union body. And we will not implement any decision issued by the current association, and we will resort to legal and union measures, including the formation of another association. He asked: “How can the mandate of an administrative body that was elected on the basis of the old internal system, that is, before the amendments, be extended?” Noting that Djibawi’s retirement as head of the administrative body is contrary to any legal text because it was referred to retirement.
As for Djibawi, he adheres to the custom that allowed former heads of retired organizations to continue to exercise their functions until the end of the League’s term.
