Exemption from her job is considered an administrative decision, whereby the employee cannot resume her job without the approval of the Council of Ministers.
The Minister of Finance, the interim government, Ghazi Wazni, who is the guardianship minister of the Director General of Customs, signed a decree to exempt Daher from his duties and sent it to the General Secretariat of the Council of Ministers, where the prime minister interim Hassan Diab signed it and sent it to the Presidency of the Republic to be signed by President Aoun. Aoun refused to sign it and returned the decree to the Presidency of the Council of Ministers, accompanied by a letter asking Aoun to implement the principle of equality among employees and to send exemption decrees for all employees to sign.
The Information Office of the Presidency of the Republic said, in a statement yesterday: “To clarify Aoun’s position, and to avoid any interpretation that does not apply to reality.” Council of Ministers. “He stressed that” employees who have been judicially detained are strictly excluded from the performance of their functions, in accordance with the laws and regulations in force, so they cannot be assigned to new tasks. “
The statement added: “There are employees, in addition to Mr. Daher, belonging to the first and second categories, who are in judicial detention, and no administrative measure has yet been taken in this regard, imposing that the procedure that must be applied to Mr. Daher must apply to all without exception, in accordance with the principle of equality ”.
While some of them saw that what Aoun did was a violation of the powers of the Presidency of the Council of Ministers, a member of the “Future” bloc, Muhammad al-Hajjar, told “Asharq Al-Awsat” that it was not a violation of the powers of the government “but a cover for a person with whom suspicions and accusations of explosion circulate in the file.” The Port of Beirut ”, which caused the destruction of half of the capital and claimed 7,000 lives, including deaths and injuries. Al-Hajjar added that the president’s stance “is related to the favoritism and cover-up of Daher, who belongs to his movement,” referring to Daher’s proximity to the Free Patriotic Movement. The General Secretary of the Cabinet returned the decree to Aoun again for him to sign. In a letter signed by the Secretary General of the Council of Ministers, Magistrate Mahmoud Makiya, the secretariat said: “Respecting the decision of the Council of Ministers, the General Secretariat of the Council of Ministers does not find what constitutes a legal justification to return the transaction, which consequently entails its return to you “.
Makiya said in response that the procedure is not disciplinary, but administrative, noting that the principle of equality “is questioned by concerned ministers” who sign decrees that exempt their administrative employees from their duties. He pointed out that, on the current September 10, he sent the draft decree to exempt the General Director of Land and Maritime Transport Abdul Hafeez Al-Qaisi from his work functions to the Minister of Finance for signature, noting that the Prime Minister will sign the decree without delay, when Minister Ghazi Wazni signs it. He will also sign all similar decrees received from the ministers concerned and send them to the Presidency of the Republic for their issuance, in accordance with constitutional principles, and therefore, bound by his constitutional obligations in his capacity as Prime Minister.
The number of people arrested on Beirut port bombing charges reached 25, according to notable notes, including former and current officers, security officials and CEOs, including the Director General of the Customs Authority, Badri Daher, the President of the Board of Directors of the port, Hassan Quraitem, and the General Director of Land and Maritime Transport Abdul Hafeez al-Qaisi.
