Concerning the constitutional aspect, Yu affirms that the president cannot circumvent the constitution after his term ends, as officially decided by the state electoral votes on December 14.
Yu responded to the question of what would happen if the president refused to resign, saying, “He may never give up and should not give up,” adding that “the United States Constitution does not in fact require that the current president does nothing one way or another. ” Trump’s term ends on January 20 and I think Joe Biden’s term will begin. “
According to the 20th amendment to the constitution, the candidate with the most votes becomes president at 12:00 noon on January 20, while the current president’s term ends that day, just before noon.

The US network “NBC” has learned of a growing sentiment among Trump’s advisers that he will never yield to Biden, even if all the ballots across the country are approved in the next few weeks.
And on the chances of Trump winning a court against Biden, Yu said the probability of that is up to 10 percent or less, adding: “We have not seen a vote count before in the presidential election that led to the heart from 10,000 to 20,000 votes in all states. “
Yu explained that Trump should reverse the results in more than one state, which is “highly unlikely,” according to the American lawyer.
