A former prosecutor who was brought to trial for sexual harassment of two junior prosecutors while serving as a practicing prosecutor was sentenced to prison in an appeal trial. Unlike the first trial, in particular, this time, he was even confined to court.
The 10th Criminal Division of the Seoul High Court (Director Won Ik-seon) sentenced former prosecutor Jin-mo (43), accused of forced harassment and other charges, to the same prison term as in the first trial in October . Previously, the first trial court sentenced him to prison on the grounds that he was not afraid to destroy evidence or flee, but did not imprison him in court, but that day the appeals court detained him in court and said: “You need to moderate.”
The Court of Appeals said: “The defendant, who worked as a prosecutor, forcibly harassed victims who worked in the same prosecutor’s office, and the blame is not slight. The victims appear to have suffered considerable trauma and injury.” Jin replied briefly, saying, “I’m sorry,” when the judge asked for opinions on the results of the sentence.
Jin was charged with sexual assault in 2015 when he served as a prosecutor for the Seoul Southern District Prosecutor’s Office in 2018, for sexually harassing two young prosecutors who were drunk at a dinner party. The prosecutor’s “truth investigation and damage recovery investigation team”, which initiated the investigation three years after the incident, also requested two arrest warrants against Mr. Jin, but the court dismissed all of them.
At first, when the controversy arose immediately after the sexual harassment incident, Jin made a resignation letter and left the prosecution without any special punishment or discipline. He refused to register as a lawyer due to the sexual harassment controversy, then landed an executive job at a large company, but resigned shortly after the investigation began.
In the course of the trial, Jin continued to deny the allegations with the effect that “it was consensual physical contact and he has never been harassed.” However, the first and second trial courts rejected most of Jin’s arguments and convicted him.
