[앵커]You had a war with the medical association and social media regarding the medical law amendment Why is this law necessary?
[김남국]Professional ethics and high social responsibility are required for all professions. In particular, medical personnel like physicians look after the life and health of patients. Also, when it comes to surgery, the patient is anesthetized and left unprotected in front of a doctor, so medical professionals are subject to a much higher work ethic and social responsibility.
However, if you observe current medical law, the case of being sentenced to more than the prison term is defined as a ground for disqualification, such as medical laws or mental illness. Since medical treatment can still be performed, it is believed that this legislation is necessary to reduce public and patient anxiety about these areas and to create a safe medical environment.
[앵커]Isn’t the disqualification of medical personnel by the medical association a violation of the constitution’s freedom of choice of professions? What are your opinions on this?
And perhaps, like doctors, there are oriental doctors, nurses, lawyers, accountants, etc. How does it compare to the professions that give certification in the country?
[김남국]First of all, free choice of the constitution does not mean that we unconditionally guarantee a license once acquired for life. Appropriate regulations and restrictions are possible.
For this reason, it is not appropriate for an ex-inmate who has committed sexual crimes, such as rape or sexual violence, to practice medical treatment himself, and therefore imposes restrictions in certain areas.
So it seems that there is no possession of unconstitutionality. It seems that fairness is important for other professional qualifications as well. Attorneys, tax accountants, legal officials, and most of these professional occupations are naturally disqualified if they are sentenced to more than one confinement.
Even civil servants stipulate it as a reason for retirement, so it is difficult to say that this in itself violates freedom of choice. It also seems that cases abroad are important too.
In the case of Germany, if you say you are arrested and tried, your license is suspended even before a final trial. Japan stipulates that the license can be suspended in some cases even in the case of fines. Therefore, in light of these cases abroad, it is difficult to say that Korea’s current revised legislation is excessive legislation or infringes on freedom of choice of profession. I think it’s difficult.

[김남국]From a licensed standpoint, I don’t know how long to expect to see you like this. However, I believe that it is not simply because of the professionalism or ability of the profession that we value and respect the professions in society.
Social responsibility is also important, and it is very important that work ethics have, and it seems that in such part there is a high social demand.
Therefore, it is not regulated in cases in which several crimes have just been solved and sentenced to more than one imprisonment, but in general the cases in such cases are defined as grounds for recusal.
And it seems like too much to say that I can’t even do a doctor in a car accident due to the negligence the medical association talks about. In real traffic accidents, if the crime of negligence is sentenced to prison, it is almost just a case of gross negligence that is almost intentional, so the case that the doctors talk about is a very rare case.
Also, in the case of violent crime, statistically, when the total number of doctors is around 100,000, it is only around 0.05%, so I think there are not many of those doctors and medical personnel who fall under this. reason for disqualification.

[김남국]Negligence and lethality in business are ignored.
[앵커]But you can also think about this problem. In the case of medical associations, they talk about the right to self-discipline, but if something is a professional society, raise the level of morality yourself. We must go in the direction of moving forward, isn’t that a good direction? that the government go ahead and regulate in this way? Lawyers are not the same, I guess. How do you see this?
[김남국]It appears to be a separate matter whether professional organizations have voluntary disciplinary rights and determine the various reasons for disqualification. Lawyers, tax accountants, and judicial organizations also stipulate that if they are sentenced to more than one prison sentence, they are not allowed to engage in legal activities or the like.
Other than that, the right to self-discipline is neglected. And there are other things that are worrying. It seems necessary to examine whether the medical association can adequately exercise the right to self-discipline beyond occupational selfishness.
If you look at national government data released last year, only 0.7% of physicians for sexual offenses were suspended from 2014 to 2018. Almost 97% of license revocation reissue, the percentage of re-approve the license. So if you just applied for reissue, you’re done.
In this case, the members of the reissue deliberation committee assess that the majority of the doctors on the deliberation committees should reissue the licenses. There are also questions about whether it can be done.

It is said that in the past, this bill must be passed. There were two initiatives in 2017 and 2018. And this bill did not start recently, but has been debated since June last year.
So in a situation where Corona 19 continues, I think it makes no sense if I ask if I cannot pass this bill because the medical associations noticed.
And if I ask you a question with another assumption, will the KMA agree or disapprove after this period is over?
