Can family and friends be invited home during the “soft” lockdown in effect on Friday, November 6 in Italy, with different rules depending on the scope of the Covid emergency? Not in Lombardy and in the other regions of the red zone. On the first day of confinement, citizens deal with the reading of the Dpcm, which will be accompanied by an interpretative circular from the Ministry of the Interior as usual, to “guide” in the correct interpretation of the regulations.
But, on the point in question, there seems to be very little to interpret. The Dpcm differentiates the measures according to the level of pandemic risk: Lombardy, as we know, was classified in the highest risk level (not without controversy on the part of the governor Attilio Fontana), the so-called red zone, together with Piedmont, Valle d’Aosta and Calabria, to which the autonomous province of Bolzano was then added.
For the red zone, article 3 of the Dpcm applies, which does not mention in all parties and receptions at home, which in paragraph 4, letter a, says:
Any movement in and out of the territories mentioned in paragraph 1 (the Regions, ed), as well as within the same territories, is prohibited, except for movements motivated by proven work needs or situations of need or for health reasons . In any case, the movements strictly necessary to ensure the realization of face-to-face teaching are allowed within the limits in which it is allowed. Return home, home or residence is allowed. Transit through the territories mentioned in paragraph 1 is permitted if necessary to reach additional territories that are not subject to travel restrictions or in cases where travel is permitted pursuant to this decree;
The statement is clear: the Lombards, except in situations of need, work needs and health reasons, cannot leave home. Therefore, they cannot even go to the houses of friends, relatives, acquaintances, unless it is a situation of need, such as assistance to a disabled person. Paragraph 5 of the same article, which establishes:
The measures provided for in the other articles of this decree also apply to the territories referred to in this article, where similar stricter measures are not foreseen for said territories.
Many doubts arose because, in article 1, paragraph 9, letter n, the decree establishes that “it is strongly recommended not to receive people who are not cohabiting, except for work needs or situations of need and urgency.” And “highly recommended” does not mean “prohibited.” But this only applies to article 1, that is, for the entire national territory (the Regions in the so-called yellow zone), and in any case only until 10:00 p.m. because then the curfew is activated.
Article 3 applies in the red zone, with the paragraphs that on the one hand prohibit any movement even “within the same territories”, therefore also (for example) within the Municipality itself, unless it is obviously necessary, and on the other hand, they exclude the application of less strict measures.
In extreme synthesis: in Milan and Lombardy, during this “soft” confinement, it will not be possible to meet friends, relatives and acquaintances at home.
