Smart work: what the new DPCM offers

The initial idea was to bring smart work to 70 or even 75% without the need for an individual agreement between the parties and until January 31, 2021, when the state of emergency should end today, unless changes later. Smart work in simplified mode is currently extended until December 31, a period currently provided by ministerial provisions.
The new DPCM, however, gives very generic recipes at the end and for the recommend professional activities that:
- they are also implemented through flexible working methods, where they can be done at home or remotely;
- vacations and paid vacations are encouraged for employees, as well as other instruments provided for by collective bargaining;
- anti-contagion security protocols are adopted and, when it is not possible to respect the interpersonal distance of at least one meter as the main containment measure, with the adoption of individual protection tools;
- Sanitation operations in the workplace are encouraged, also fostering forms of social safety nets for this purpose.
Provisions for employee smart work without specific reference to the AP. The provisions of the converted August decree remain valid especially for fragile workers and until June 31, 2021 for parents with children with severe disabilities.
