Prime Minister Giuseppe Conte announced this afternoon the new restrictive measures that will be in force during the Christmas holidays, contained in a new decree whose text was published later overnight. In summary, all of Italy will be the red zone from Thursday 24 to Sunday 27 December, from Thursday 31 December to Sunday 3 January, Tuesday 5 and Wednesday 6 January. Instead, it will be the entire orange zone – with greater freedom of movement and the stores open – from Monday, December 28 to Wednesday, December 30 and Monday, January 4. In all these days, however, there is a derogation that allows visits to friends or family, with strong limitations that still have some unclear aspects.

The new rules are added to those established by the decree law of December 3, which establishes that from December 21 to January 6 it is not possible to move between different regions (including the autonomous provinces of Trento and Bolzano) except for travel motivated by proven work needs, situations of need or health reasons, and returns to their residence, domicile or home. The same decree also established that from December 21 to January 6 it will be forbidden to go to second residences that are in an autonomous community or province other than one’s own.
The exemption to travel to the home of others
The most important novelty of the decree was initially roughly communicated at a press conference, and only partially clarified by the text of the decree published on the night between Friday and Saturday on official government channels. From January 24 to 6, both in the red zone and in the orange zone, there is an exception to the normal prohibition to travel outside the municipality itself (provided for by the regulations of the orange zones, except for the smallest ones) and within of your municipality (required by the regulations for red zones).

The derogation establishes that you can visit the home of another person, friends or family, but respecting some rules. You can only visit a house, only once between 5 and 10, within your region (and therefore also outside your municipality). This transfer can be carried out in a maximum of two people, to which children under 14 years of age can be added, without limitation of number, and disabled or not self-sufficient people who live together. This derogation, says the decree, is valid for every day from December 24 to January 6.
Some questions remain unclear even from the text of the decree: one is whether the house you choose to visit should be the same for the entire vacation period, or whether it should be just one on the same day. The text only says “it is also allowed to move to a single private house, located in the same region, once a day.”
The other refers to the limit of people that can be received at home. Conte said that “it is possible to receive up to two people who do not live in your house”, in addition to children under 14 and disabled or not self-sufficient people. The decree speaks of the movements, saying that they are limited to two people “beyond those who already live there”, referring to the house that is visited. Always Conte, responding to a question about this ambiguity, said that “a liberal democratic system does not send the police to the house to check what they are doing”, and that “the prohibition, when you have the kindness to read the decree law, it was conceived as a limit to circulation. ” Then he added: “Those who circulate on the street will declare where they are going, if they go to a house it can be verified later, it is clear.”
The other rules on red zone days
Unlike the derogation, on red zone days it is possible to move between municipalities only due to the usual exceptions, that is, for proven work needs, situations of need or health reasons. All movements will be prohibited from 10pm. Both bars and restaurants will be closed (with the possibility of selling take-out food until 10 pm and home delivery without time restrictions) and shops, but supermarkets, pharmacies and parapharmacies, kiosks and tobacconists may remain open. Motor and sports activities are allowed, if they are solitary.
The other rules in the days of the orange area
Once again, with the exception of the aforementioned repeal, travel between municipalities will be prohibited on days in the orange zone. However, there is another exception: those who live in a municipality with fewer than 5,000 inhabitants may move within a maximum radius of 30 kilometers, avoiding the provincial capitals. Self-certification will not be required to move around your municipality.
Bars and restaurants will be closed, but shops will be able to open instead, which can remain open until 9:00 p.m.
