Those who have children in quarantine can request a smart job or an extraordinary license: this is what the decree establishes

In the case of children and young people under 14 years of age who are quarantined for risky contacts at school, parents can ask extraordinary license and smart work during the entire period of isolation: it is one of the main measures of the decree law with the “Urgent provisions to face the financial and support needs that cannot be postponed for the beginning of theschool year, connected to the epidemiological emergency of Covid-19 ″ signed by the president Sergio Mattarella and published in the Official Gazette.

The content of the provision refers to the financing of additional spaces for the realization of teaching activities in person. The decree law also incorporates the news about local public transport after the State-Regions agreement, while, in Article 2, the question of school transportation. But it is on the benefits for families where the main novelties come: “An employed parent can perform the work performance in agile mode during all or part of the period corresponding to the duration of the quarantine of the cohabiting child, under fourteen years, managed by the ASL Prevention Department with territorial jurisdiction as a result of the contact that occurs within the school complex ”.

The decree also specifies that it is also possible to obtain a license but in particular cases, that is, “only in cases where job performance can’t be done in agile mode and in any case as an alternative to the measure mentioned in paragraph 1 – says article 5 – one of the parents, alternatively to the other, can refrain from working during all or part of the period corresponding to the duration of the quarantine of the minor under fourteen years. “For the periods of leave indicated in the decree,” it is recognized, in substitution of salary and in accordance with paragraph 6, compensation equal to 50% of one’s own salary, calculated in accordance with the provisions of article 23 of the consolidated act of the legislative provisions on protection and maintenance of maternity and paternity (….) The aforementioned periods are covered by a theoretical contribution ”.

Family concessions are valid only for one parent at a time and they are valid until December 31, 2020. For these benefits the decree law recognizes a spending limit of 50 million euros by 2020. INPS will control spending limit: Once the spending limit has been reached, even prospectively, INPS will not consider any further questions.

Funds have also been earmarked for the replacement of school personnel that avail themselves of the benefits of the decree: “The public administrations provide the activities referred to in this article with the human, instrumental and economic resources provided for in current legislation and without new or greater charges of public finances “.
