On smart work, the government aims to put into practice Law 81 of 2017 which introduced the exclusive mechanism of the individual written agreement between the company and the individual worker. Collective bargaining will govern agile work, with a more pronounced role that will be entrusted to national or company contracts that can regulate issues such as the right to disconnect, deal with conciliation, for example to avoid sanctions for workers who are already overwhelmed. take care of family members or arrange the delivery of food stamps.
These are the hypotheses of intervention in the study of the Minister of Labor, Nunzia Catalfo, who on September 24 called the unions (in the morning) and employers (in the afternoon) to the table on agile work, with the intention of change the framework of the Del Conte law approved just three years ago, radically innovating with respect to teleworking.
The growth of agile work due to the pandemic
Until 2019, the Politecnico di Milano’s Smart Work Observatory (it has been studying this way of working since 2012) “had 570 thousand agile workers, especially in the private sector – underlines the director, Fiorella Crespi -. This year, due to the health emergency , smart work has potentially affected 6 to 8 million workers, including SMEs and the public sector, in many cases even for 5 days a week. ”At the end of the simplified regime on October 15, it is estimated that within Government 4/5 million workers could remain in agile mode, even improperly -including, for example, even self-employed and professionals-, who will alternate two or three days a week in presence, and the rest “at a distance”. The Ministry of Labor, during the lockdown, spoke of 1.8 million agile workers, from the private sector, based on the communications received (therefore, they are partial data); and today around the 50 percent would stay in this mode.
Towards new rules: the hypotheses under study
Given the numbers involved, and the application that the tool has had in recent months, Minister Catalfo has decided to review the discipline. Among the hypotheses that are being studied is also that of setting the percentage quotas for the use of smart work at the national contract level, in line with what has been done, with specific directives, by the Minister of the AP, Fabiana Dadone, indicating the objective of have this 50% of the personnel involved in remote work per year and in 2021 the objective is 60% (after the preparation by each administration of the Organizational Plan for agile work, the so-called Pola). In a recent seminar organized by the M5S, Minister Catalfo recalled that agile work “in the public administration has been widely used: in the Ministry of Labor, more than 80% of workers have put themselves into smart work.”
The deadline of October 15
These innovations should reach the goal after the October 15 deadline, when in correspondence with the end of the state of emergency, the current simplified mechanism that allows the employer to resort to smart work with a unilateral decision will end.
