Ok from Tar Campania until the reopening of first grade and of preschool Tuesday November 24th. The administrative court, with two different decrees published today, rejected the appeals of some parents against the ordinance of the Campania Region that ordered the reopening of schools for next week. Planned opening, however, from Dpcm of November 3 also for the red areas for elementary school, kindergarten and high school. Only in Campania, in fact, primary schools are still closed due to an ordinance of the De Luca council, which established the reopening for next Tuesday limited to schools from zero to 6 years old and the first classes of primary school. A decision that some parents who have appealed did not like. For administrative judges, however, De Luca’s board device is legitimate.

The judges: “De Luca’s order legitimizes”

With decrees number 2153/2020 and 2161/2020, the TAR from Campania rejected the appeals filed by so many groups of parents against Regional Ordinance no. 90/2020, with which the gradual resumption of teaching activities in presence in Campania schools was scheduled from November 24, after the selection of teacher and non-teacher staff and on children and their families.

The Court affirmed “the legitimacy of the challenged Ordinance, taking into account that, in the context of the persistent health emergency – increasingly aggravated for the Campania Region, pending to be included in the so-called” red zone “- it intends to correspond precisely to the needs expressed by the parents, also in the interest of the minors, for the rapid resumption of activities “in presence” and identifies, for this, a path necessarily characterized by gradualness and prudence, accompanied by new pre-ordered precautionary measures (voluntary preventive screening in a large number of teaching and non-teaching staff employed in the school, monitoring and subsequent evaluation of data related to the trend of the epidemiological curve). The regional arrangement is reconciled with balance and reasonableness – according to the TAR – the priority nature of the right of citizens to health with the needs that the applicants represent “.

Tampon delays, parental anger

Meanwhile, parents are asking for clarity on the smear procedures of their children, not mandatory, but recommended by the Campania Region, after the difficulties registered in the operation of the toll-free number, created on Tuesday, until today. In this situation, some mothers ask to continue distance learning for those who cannot use swabs. While social media are emerging parent groups who are afraid of having to send their children back to school because the numbers of the Covid-19 contagion “are still high” and launch the # il24scuolechiuseincampania campaign. On social networks, every day, immediately after the publication on the official profiles of the Campania Region and President Vincenzo De Luca, mothers and fathers who have joined the initiative, write a single comment, en masse : # il24scuolechiuseincampania. A fashion mafia, in the intention of the organizers, in full compliance with the anticovidias regulations and restrictive measures provided for the red zone. By doing so, they hope to convince De Luca to keep the institutes closed. The group created on Facebook is called “We protect the health of our children” and it has about 19 thousand subscriptions.
