TURIN. The Piedmont TAR rejected the request for an urgent suspension of the resolution on the school signed by Alberto Cirio. The news represents an unexpected turning point in the clash between the Region and the government: the issue is the controversial regional ordinance that integrates state guidelines, which provides for self-certification of student temperature control by families, and the control on the part of the schools of fulfillment of the obligation, schools that in the absence of the certificate of the parents on the fever of the children will have to provide directly. A victory for the Region, at the call of the government, accompanied by heated controversy.

The comment of the lawyer Vittorio Barosio, professor of administrative law, one of the leading experts in Italy, who defends the Piedmont Region: “It seems to me that the decree of the TAR president is absolutely correct. In fact, the decree itself is very carefully motivated and with a wide range of arguments. It recognizes, in essence, that the decree of the President of the Region does not transfer responsibility for measuring temperature to schools and does not subvert the government decree system.
In other words, the decree of the President of the TAR confirms that the decree of President Cirio in no way removes the obligation of families to measure fever in children and only provides for a control – absolutely necessary for public health – by the schools. This control aims to guarantee the obligation to measure the temperature. And therefore, contrary to what the Government’s appeal affirms, the regional provision does not relegate families, but rather emphasizes their obligation by stating that, if it fails, there will be school supervision ”.
