The reopening of schools on January 7 is approaching and questions about the organization are becoming more frequent. We know that the State-Regions agreement establishes that the return of secondary schools will be made from 50% of the students who attend.

The document of understanding commits, among other things, the parties to guarantee that from now on “Any new suspension or limitation of classroom teaching activities is expected as a residual measure.”

The agreement also provides for the competent institutions to reprogram, on the basis of the operational documents prepared by the tables managed by the Prefects, local and regional public transport services and the consequent need to activate additional services to guarantee the correct development of the school year.

Can I leave more students in the integrated digital teaching and, consequently, avoid reorganizing the schedules?

No. The decree of the President of the Council of Ministers of December 3, 2020 and the ordinance of the Minister of Health of December 24, 2020 grant each student the subjective right to carry out the teaching activity in the presence of 50% of the school time between January 7 and 16, and 75% from January 18. Unless there are new and different government regulations, it is not allowed to reduce these percentages. Families could challenge the unilateral reductions in court. There remains the possibility that students waive this right, for example. because they are “fragile”, as long as they remain at a distance.
