What happened? The Abruzzo Region has decided with an autonomous provision to reclassify itself as an orange zone, while the 21 parameters that measure the risk level of the regions would have circumscribed it as a red zone. Abruzzo President Marco Marsilio signed an ordinance that as of today places the Abruzzo territory in the orange zone. «Dear President,
reference is made to regional ordinance no. 106 of December 6, 2020, which ordered the application, in the territory of the Abruzzo Region, of the measures referred to in article 2 of the dPCM of December 3, 2020, with the consequent classification of the same Region in the “orange zone”. The aforementioned regional ordinance ordering the application in the Abruzzo region of measures to prevent the spread of the COVID19 virus in accordance with art. 2 of the Prime Minister’s Decree of December 3, 2020 violates art. 1 of the Ordinance of the Ministry of Health of December 5, 2020 which, classifying the Abruzzo Region as a Region included in the “type 4 scenario” and with a high risk level “(the so-called Red Zone), provides for the application in the territory of Abruzzo of stricter preventive measures in accordance with article 3 of the aforementioned Decree of the Prime Minister of December 3, 2020. In this regard, it is observed that, in accordance with current legislation, the application of the measures Relating to a lower scenario (“orange zone”) is derived from the evaluation of the fourteen-day stay in a risk or scenario lower than that determined by the restrictive measures (“red zone”), verified by the control room.
With reference to the Abruzzo Region, the competent control room, in the follow-up of last November 20, noting that the Region had been at a high risk level for 3 or more weeks, indicated “critical problems compatible with a possible increase of transmissibility in the short term, which in turn could place the Region in a superior scenario. These considerations, in accordance with a precautionary principle, recommend the convenience of the most restrictive measure in the Abruzzo region. ” Therefore, the ordinance of November 20 was adopted, with which, as of November 22, the measures referred to in article 3 of the Decree of the Prime Minister of November 3, 2020 were applied to the Region. Only on November 27, the first time, a reduction of the epidemic scenario was verified, later confirmed by the monitoring of December 4 as a direct effect of the additional restrictive measures, so that – to date – the condition to which refers to Article 1, paragraph 16-ter, of Decree-Law n. 33 of 2020, which for the purposes of a new classification, requires “the evaluation of the stay for 14 days at a level of risk or scenario lower than that determined by the restrictive measures, carried out in accordance with paragraph 16-bis, as verified from the control room “.
It should also be noted that, as recognized in the minutes of the Control Room of December 4, 2020, the anticipation of the measures adopted by the Abruzzo Region with Ordinance 102 of November 18, 2020, could have allowed to consume all the expected period for the declassification. to which the aforementioned legislation refers, not before Wednesday, December 9.
