Security decree, Daspo of public places for violent people: the “Willy” rule arrives, more severe penalties

A marked overcoming of the two Salvini security decrees that, unlike the current measures, foresees the return to the “reception and integration system”. With the addition of two rules to exacerbate the local Daspo and penalties for violent people and drug traffickers, which comes after the murder of young Willy Monteiro.

For NGOs that violate the navigation ban, fines of up to one million disappear, they drop from 10,000 to 50,000 euros, and rescue operations “communicated promptly” are reserved, but there is a prison term of up to 2 years for activists at sea that they do not coordinate with the maritime authorities of the flag countries and those that operate rescue. The prohibition with the limitation of the transit of ships, which the Salvini decrees had informed the Ministry of the Interior, dates back to the Ministry of Transport. The latter will decide on the proposal of the Minister of the Interior, after consulting the Minister of Defense.

The observations made by the Quirinale several months ago are recognized, as well as the reintroduction of compliance with constitutional and international obligations on the options for the transfer of the residence permit. Cases of “special protection” affecting those persecuted are also expanding. We go back to the past: not only those fleeing torture will be considered, but also inhuman and degrading treatment. The mandatory periods for the recognition of Italian citizenship go from 48 to 36 months.

Among the novelties, also the restoration of the possibility – for applicants for international protection – to register in the municipal registry and convert the residence permit into a work permit. In detention centers for repatriation (CPR), the transfer of prisoners becomes a priority. The entertainment in the CPR ranges from a maximum of 180 to 90 days, but it can still be proposed for another 30 days if the foreigner is a citizen of a country with a readmission agreement. Regarding the care of asylum seekers, there is a scheme that provides for two levels: the first refers to reception in the Extraordinary Reception Centers (Cas), predictably during the time necessary for the presentation of the asylum application.

Then generalized assistance in the territory in small groups, in the so-called structures of the Protection System for holders of international protection and for unaccompanied foreign minors (Siproimi). Finally, the penalties for the crime of brawl and the Daspo of public places and entertainment are aggravated for those who have been denounced or convicted of acts of violence outside a club. A “Willy rule” that increases the penalties for those who have participated in a fight, raising the fine from 309 to 2000 euros and the prison sentence – if someone is injured or killed in the fight – from a minimum of six months to a maximum of six. years (now it goes from three months to five years).

For the protagonists of riots or acts of violence, the commissioner can order the Daspo from specific premises or public establishments: in case of violation, there is a prison sentence of up to two years and a fine of up to 20,000 euros. The Daspo against drug traffickers is toughened and a rule arrives to combat drug trafficking through the web: a list of sites used for drug dealing is created, whose access must be inhibited by internet connectivity providers, with fines of 50 thousand 250 thousand euros for those who break the law.
