Mandatory tests Sardinia, the Government challenges the ordinance – Ultima Ora

(ANSA) – CAGLIARI, SEPTEMBER 15 – The State Prosecutor’s Office has lodged an appeal against the ordinance of the Sardinia Region, in force since yesterday, which provides for mandatory tests for passengers who enter the island who have not presented themselves boarding with a Covid-19 negativity certification.

ANSA learns from sources in the Democratic Party. Failure to comply with article 16 on the free movement of persons is the fundamental reason for the appeal lodged with the TAR of Sardinia.

The investigation into the ordinance was opened immediately after its publication by the Minister of Regional Affairs, Francesco Boccia, who worked on the legal study with the Minister of Health, Roberto Speranza, and the State Attorney. Presumably, in the appeal filed with the TAR there is also a request for suspension. Now, the President of the Administrative Court will decide whether to discuss it in the next council room or whether to proceed immediately, therefore, within a few hours.

The appeal was expected yesterday, on the first day of the ordinance that caused chaos in Sardinian airports with disoriented passengers and management companies struggling with a rule defined as “an enigma.” (HANDLE).
