A few days later, the government updated the Frequently asked questions in the DPCM of December 3 with restrictive measures for Christmas and New Years.

Curfew, second painting, visit to elderly parents, committed and much more: the Ministry responds to the most common doubts derived from the new prohibitions.

The return home, home and residence and theassistance to the elderly not self-sufficient.

Below are all the clarifications posted on the website of the Council Presidency.

Specific FAQs for the period from December 21, 2020 to January 6, 2021

Among the frequently asked questions, the first distinction produced by the Executive is the one that differentiates the crucial concepts of residence, domicile and domicile, where re-entry is always allowed even in the period between December 21 and January 6.

Hence the distinction and definition of the three concepts:

Residence

That is the place where the person has his habitual residence. Residency results from the registry office and is therefore “Knowable accurately and verifiable at any time”; so be careful to declare falsehood on the self-certification form, you risk 1 to 6 years in prison.

Home

Defined as the place where the person has the main place of business or interests, it may not coincide with the residence. For non-resident students, for example, home is the place where they live for a specified period of the year and attend classes.

accommodation

Another place where returns are always allowed is the “home”, understood as the house in which “People actually live, with some continuity and stability (therefore for continuous, albeit limited, periods during the year) or with usual periodicity and frequency (for example, on certain days of the week for work, study or other needs ) “. The concept of housing does not include second vacation homes.

My spouse / partner and I live in different cities for business needs (or other reasons). Will it be possible for him or me to meet him, even after December 21, to spend the holidays together?

Moving to a spouse / fiancé is only possible if the place chosen for reunification coincides with the residence, domicile or home.

The rules about travel, store openings, restaurants, etc. Will they be valid for everyone, regardless of the “color” of the area where you live or where the store or restaurant is located?

Regarding shopping centers, clothing stores, bars and restaurants, the distinctions between the yellow, orange and red zones remain in force in the period between December 21 and January 6.

Only in the yellow zone, therefore, you can go to the restaurant for lunch at Christmas, up to a limit of 4 people per table (if they do not live together).

In which cases is it possible to move to the second home in the period between December 21, 2020 and January 6, 2021?

The rules to follow to go to second homes are the following:

  • in the yellow and orange zone, if the second house is located in the same municipality, you can always comply with the curfew from 10 pm to 5 am and from 10 pm to 7 am on January 1;
  • In the yellow zone, if the second house is in the same region but in a different municipality, you can go from December 21 to January 6, except for Christmas, San Esteban and January 1, 2021.

My spouse / partner will be moving into our second home in another region on December 20th. Will I be able to meet with him between December 21 and January 6? And if our younger children move with him / her to the second house, could I join them?

To these questions the answer is “no”. The current DPCM prohibits travel between regions from December 21 to January 6, without exception for second homes.

“If they intend to vacation together, they must be in the same place before December 20, 2020.”

My family and I will be moving into our second home in another region on December 20th. I will have to go back to work in my home region for a few days. Will I be able to return to them before January 6?

Once again, the government’s answer is “no.” The transfer of the second home to the workplace in the period between December 21 and January 6 cannot be used as a justified reason for the transfer.

My parents, elderly but in good health, live in a different region than mine. Can I visit them during the holidays?

Visiting elderly parents outside of the region are not allowed from December 21 to January 6, unless they are not self-sufficient and need help. The transfer to the home of the parents / children is only allowed within the region, if both live in the yellow zone, and only within the municipality on December 25 and 26 and January 1.

“Displacements to visit or go live for a few days with family or friends, including their parents, will be possible for everyone only if one moves from one place in the yellow zone to another in the yellow zone exclusively until December 20, 2020 already as of January 7, 2021 “.

Can separated / adoptive parents travel between December 21 and January 6 to go to different municipalities / regions or abroad to spend the holidays with their minor children, in compliance with the provisions of the judge or the agreements with the another parent?

Divorced or separated parents can visit their children during the holidays, even if they live in different regions. In this case, the movement is framed within the reasons of “necessity” and therefore is not subject to the limitations imposed between December 21 and January 6.

In the case of travel to / from abroad, the website of the Ministry of Foreign Affairs should be consulted for information on the health requirements of the country of destination or origin.

I have relatives who are not self-sufficient who live alone at home, in another municipality / region, and whom I attend regularly. Will I be able to continue doing this also from December 21 to January 6? Will my spouse / partner and our children come with me?

Providing assistance to a non-self-sufficient relative / friend / parent is a reason of “necessity” and is always allowed, even if it is necessary to travel to another region and in the period between December 21 and January 6.

but nevertheless “The need to provide assistance cannot justify the movement of more than one adult relative, possibly accompanied by minors whom they usually attend to.”

Under the new DPCM is it allowed to go to another municipality or region for tourism?

Travel outside the city and travel for tourist purposes are allowed in the yellow zone regions until December 20 and from January 7, 2021. Extra-regional travel for tourism in Italy is prohibited between December 21 and January 6th. Without ski holidays, the ski resorts are closed to the public until January 6.
