Antonino Monteleone and Marco Occhipinti collect exclusively the story of a man who frequented the house of the massacre in the months prior to the massacre and narrates a strong rivalry between the group of Tunisians close to Azouz Marzouk and the Moroccans who sold in the same area. Meanwhile, the Supreme Court has denied the request of attorneys for Rosa Bazzi and Olindo Romano to analyze the new findings from the Erba massacre.

The Supreme Court has just said no to the request of Rosa Bazzi and Olindo Romano’s lawyers to analyze the new findings of the Erba massacre. It is about artifacts found at the crime scene and that in twelve years no one has examined before. Among these are the clothes of the sole survivor Mario Frigerio and little Youssef Marzouk. Rosa and Olindo were Sentenced to live in prison for the murder of Raffaella Castagna, his son Youssef, his mother Paola Galli and the nearby Valeria Cherubini in what the court’s prosecutor described as the most atrocious criminal enterprise in the history of the Republic.

We have been dealing with this story for about two years and we have tried to explore the many gray areas that cross it and in many of them a question arises: what if we were faced with a possible judicial error that it has had? led two innocent people to life imprisonment? Below you can find the main articles and services that we have recently dedicated to this case.

In the new service you see above, dedicated to the Erba massacre, Antonino Monteleone hears the exclusive testimonial of a man who frequented the house of the massacre in the months prior to the massacre. These are unpublished statements, which reinforce the reasons of those who still believe today that it would be important to be able to analyze those never-analyzed findings found in the house.

There are those who hypothesized the presence of unknown murderers who, according to the defense and not only, could have brought alternative clues that could not have been thoroughly investigated by investigators in the days after the massacre. Among the main tracks initially there was only that of “Bad acquaintances” by Azouz Marzouk, the Tunisian with a criminal record who lost that night what he loved most in the world and who is not entirely convinced by the conclusions reached by 26 judges at three levels of trial.

The Erba carabinieri had considered the competitiveness of different ethnic groups among the first hypotheses in the deal business between Tunisians close to Azouz, who gravitated towards the municipality of Merone, and Albanians from Ponte Lambro, both towns in the province of Como and not far from Erba. The hypothesis was soon discarded because the carabinieri found no evidence. But no one had ever told him about the Tunisian rivalry, at that time, with another group that deals with the area.

To tell us what it is I am kais, Tunisian detained together with members of the “Marzouk clan”, and who appeared to be residing in the home of Azouz and Raffaella, a meeting place for friends and relatives of the Tunisian. The man tells Antonino Monteleone a strong rivalry between the group of Tunisians close to Azouz Marzouk and that of Moroccans who sold in the same area between Erba and Merone, municipalities in the province of Como. Rivalry that would have resulted in a stabbing fight by the Moroccans against Abdi Kais and his brother and two cousins of Azouz Marzouk.

“Some Moroccans stabbed me, Azouz’s brother, cousin Borhen and Borhen’s brother who lives in Como. There were drug problems,” says Abdi Kais in the report you can see above. According to the man’s statements, the Tunisians would have had the worst with stab wounds and Abdi would go to the hospital for treatment. The episode would have led to a real dispute between the two groups. And not only: “A Tunisian, Amer, always hid cocaine in the basement, (by Azouz and Raffaella, ed.) ”, says Kais again. “Because from the hiding places in the forest in front of Merone he often disappeared. Therefore, the man claims that quantities of cocaine were hidden in the basement of Raffaella and Azouz’s house, a stone’s throw from Piazza del Mercato, the store square in Erba.

According to Kais, it was not Rosa and Olindo who committed the massacre, because incompatible by construction, physical preparation, speed of execution for this type of massacre of sacrificed men and women: “There are 5 people, not one or two. Looking at Olindo and Rosa, it is not possible. Raffaella’s constitution was strong enough, it is not easy to tear it down. On the other hand, those Moroccans were aggressive in the way they drew their knives, I couldn’t imagine it, and I’m also an athlete so I know how to defend myself ”.

In recent years, the defense of Rosa and Olindo has asked the Supreme Court to analyze the findings found at the crime scene on three occasions and despite three favorable rulings in this regard, the Courts of Como and Brescia from time to time they did not consent to these analyzes.

And so for the fourth time the defense of Rosa and Olindo returned to the Supreme Court. “Unfortunately, the opposite news has arrived,” says Fabio Schembri, attorney for Rosa Bazzi and Olindo Romano. “In the sense that there was a rejection which currently prevents the analysis of these findings, which would have been very important to analyze in order to present the request to reopen the process together with other elements ”.

The appeal was rejected, but there is still a glimpse of the reasons, not yet published, which will accompany this decision. “I hope and hope that in the motivation the Court of Cassation can indicate a way through which we can analyze these findings,” continues Schembri.

A possible analysis of the findings could be decisive trace that Rosa and Olindo DNA never found at the crime scene and then throw away the key that locks the two convicts or to identify the DNA of strangers, which would suggest the presence of unknown killers, and in this eventuality reopen the case.
