Fugatti Ordinance and DPCM Conte: “local” rules at risk of appeal, here are differences and unaltered parts

[ad_1]

The ordinance issued yesterday by the president of the province, Maurizio Fugatti, receives the Prime Minister’s Decree from Prime Minister Giuseppe Conte, but departs from it in some points by loosening the “grip”. And therefore runs a high risk of being “challenged” by the Government, with the consequent dispute over the conflict of powers. Rome could challenge the Fugatti ordinance already today, but in Piazza Dante they know well that an opinion on the merits takes at least twenty days, which would allow the Province of Trento to go beyond mid-November with the “autonomous” rules. .

AND REASONS – For Fugatti, the ordinance is based on the different situation of contagion in Trentino. «Our current sanitary and epidemiological situation allows us to resign»Is the key phrase. According to the province of Trento, that is, the national decree must “adapt” to the situation in Trentino. This is not allowed in other regions with ordinary status.

THE DIFFERENCES:

– Hours of bars, pastry shops and restaurants. The national decree imposes the obligation to close and the prohibition to serve drinks after 6:00 p.m. Instead, the Fugatti order establishes that bars and patisseries can be open from 5:00 p.m. to 8:00 p.m. Restaurants, from 5:00 p.m. to 8:00 p.m. 22.

– Shops and shopping centers. The national DPCM does not provide for trade restrictions. Instead, the Fugatti ordinance provides for the total closure of commercial establishments on Sundays (both small shops and shopping centers). The only exception: pharmacies, drugstores, newspapers and tobacconists.

– DAD (DISTANCE TEACHING). The DPCM Conte states that secondary schools immediately implement distance learning for a minimum of 75% of instructional hours. For Fugatti this is not justified in Trentino, where there will be lessons “in presence” for as long as possible. Fugatti’s comment: “Because distance education is always a small great defeat.”

– SCHOOLS OF DANCE AND MUSICAL. Not having suspended the educational activity, the Fugatti ordinance has a curious repercussion: music or dance schools can remain active “if they are registered in the Register of schools of the province of Trento”. The manager De Col assured it. So, for example, sports training is prohibited in the gym, but if a dance class is given in that gym, it is allowed.

CONVERGENCES:

– SKI FACILITIES. The national DPCM delegates to the Regions the creation of security protocols that allow the activity. Fugatti announced that he has continuous contacts with neighboring regions (Veneto and Lombardy) and with Alto Adige to reach a single protocol for skiing. Percjhé “the economic sector is too important for our economy.”

WHAT DOES NOT CHANGE:

– MUSEUMS. The Province of Trento does not modify the discipline of the museum’s activities, which can continue with safety and distancing regulations.

– THEATERS, CINEMA AND SHOWS. While the nearby province of Bolzano has “saved” the opening of theaters, the province of Trento has not provided any ad hoc regulations. Therefore, despite the “favorable health and epidemiological situation”, theaters and cinemas remain closed. “We don’t change anything,” Fugatti said at the press conference.
