The couple, assisted by attorneys María Rindinella and Lorenza Parenti, argue that the house is not enforceable because it is within a capital fund, established in May 2009. Judge Paolo De Paola, however, decided to agree with Taormina. The reason is that this fund was created by her husband, as Franzoni’s guardian when it was banned after the criminal conviction – guarantee the material and moral needs of the family. The debt owed to the lawyer to defend the woman in court is also linked to family needs. If the debt has these characteristics, clarifies the judge, the fund cannot be grounds for opposition to the seizure.

Franzoni returned there for a few days immediately after returning to freedom, only to later move to the Bolognese Apennines.
