The coronavirus is scaring Europe again. The situation, according to reports from the EU Health Commissioner, Stella Kyriakides, is worse than in March although in some countries, such as Italy and Germany, it seems that the epidemic is under control.

Covid-19 puts two countries in trouble in particular: France and Spain, but the UK is not having as much fun as Belgium and the Netherlands. The EU therefore calls on governments to carry out more tests, improve monitoring and strengthen public health. Italy is “surrounded” by Covid-19, but the country seems to be responding better than in February-March. Much will depend on the epidemiological curves of neighboring countries.

The government will decide shortly before the deadline with the executive that intends to evaluate the number of infections generated by the school effect in early October.

One thing, however, according to the newspaper, should be clear: if the state of emergency has been extended from July 31 to October 15 at the “weakest” moment of the epidemic, it is unlikely that it can be extended until at least on December 31 when a resurgence of the virus is expected.

State of emergency, what does it mean

Underlining, once again, that a state of emergency does not mean confinement, The purpose of the extension of the state of emergency is to allow the government to launch urgent measures such as the Dpcm without going through Parliament and Civil Protection to buy masks or anything else that is necessary without going through bids or contests.

A state of emergency can be declared before the occurrence or imminence of natural disasters or events related to human activity in Italy. It can also be declared in the event of serious events abroad in which the Italian civil protection is directly involved.

The Civil Protection Code (Legislative Decree No. 1 of January 2, 2018), redefines the duration of the state of emergency of national importance, taking it to a maximum of 12 months, extendable for another 12 months.

The Council of Ministers can decide on the state of national emergency, without having to go through Parliament, for type C disasters. In Italy, in fact, these events are classified into 3 types depending on the scope, intensity and response capacity of the civil protection system: type A provides for a direction of interventions at the municipal level, type B at the provincial level and regional, type C at the national level.

The state of emergency can also be declared by the Council of Ministers as a preventive measure, that is to say “before the occurrence or imminence of natural disasters or events related to human activity in Italy”. It can also be declared in the case of “serious acts abroad in which the Italian Civil Protection participates directly.

At the end of the state of emergency, a “closure” order is issued, which governs and regulates the control of the competent administration in the ordinary way and therefore the return to normality.
