As we anticipated two days ago, the MI has prepared the note that contains instructions and operational instructions on the subject of substitutes for teaching, educational and ATA personnel for the academic year. 2020/21.
This is the prot note. north. 26841 of September 5, 2020, with which the Ministry, with regard to teaching and educational personnel, refers to OM n. 60 of July 10, 2020 (Procedures to establish the provincial and school rankings referred to in article 4, paragraphs 6-bis and 6-ter, of Law No. 124 of May 3, 1999 and for the assignment of substitutes relative to teaching and teaching staff) who have re-disciplined everything related to the allocation of substitutes.
Substitutes for teachers and educational staff
The assignment of substitutes for the 2020/21 school year will be arranged by the provincial and school rankings established in the implementation of OM 60/2020. The current school classifications for the 2017/2018, 2018/2019, 2019/20 triennium, with the exception of the first strip, are no longer valid.
The identification of the recipient of the substitution is carried out by the director of the territorially competent school administration in the case of use of GAE and GPS and by the director of the school in the case of use of school classifications.
Resignation or absence of the call
The resignation or absence of the call entails the loss of the possibility of obtaining the substitution based on the GAE and the GPS according to the ranking that intervenes in the call for the relative teaching.
The resignation to the lists of EAG for support allows the acceptance of another appointment by the same EAG for common position.
Use of MAD
After school ratings are exhausted, including ratings for neighboring schools, the school principal makes use of aspiring teachers who have submitted an Availability Request (MAD).
Requests for making available must be submitted exclusively by teachers who are not registered in any provincial and school rankings and can be submitted for a province to be explicitly declared in the request.
If more requests are received, school administrators will prioritize qualified teachers and specialized teachers.
In any case, the requests for benefits that are made in the form of self-certification must contain all the necessary statements that allow the timely verification of the requirements by school leaders, including the details of obtaining the title and / or the title of specialization. .
Allocation of additional hours
In first and second grade secondary schools, the principal may assign, as additional hours to the compulsory ones, up to a maximum total time of twenty-four hours per week, with the consent of the interested parties, the same teaching hours or less than six hours per week, that they do not contribute to the creation of chairs or positions of time, to the professors of the autonomic establishment, in possession of a specific qualification or specialization in support or, alternatively, a valid qualification for the teaching of the discipline.
ATA staff substitutes
ATA staff positions, except those of the DSGA profile, which cannot be assigned through permanent positions, are filled with the assignment of annual or temporary substitutes until the end of the teaching activity.
For this, the permanent provincial rankings by qualifications referred to in article 554 of Legislative Decree No. 297/94 are used and, if they are exhausted, the provincial lists and rankings prepared in accordance with Ministerial Decree 04/19/2001, n. 75.
Only in the event of exhaustion of the permanent rankings of the provincial powers based on the qualifications referred to in art. 554 of Legislative Decree no. 297/94 and provincial lists and rankings until exhaustion prepared in accordance with Ministerial Decree 19.4.2001, n. 75 and Ministerial Decree 24.3.2004, n. 35, residual availabilities are assigned by competent school administrators, by shifting the classifications of schools.
The acceptance of an annual replacement proposal or until the end of the teaching activity does not prevent the applicant from accepting another replacement proposal for different professional profiles, always of annual duration or until the end of the teaching activity.
End of schedule
For substitutions assigned in an hour segment, completion is guaranteed in any case. It is allowed to leave a segment to accept a full seat, provided that at the time the segment was called, there was no availability for the full seat. Completion can only operate between posts of the same profile.
Short substitutions
Regarding the replacement of temporarily absent ATA staff, school administrators may grant temporary replacements.
In this regard, however, the note recalls that school administrators cannot confer short-term substitutions:
a) personnel belonging to the professional profile of administrative assistant, except in educational centers whose personnel by law have less than three positions;
b) personnel belonging to the technical assistant profile;
c) staff belonging to the profile of collaborator of the school, during the first seven days of absence.
The art. 1, paragraph 602, of law 27.12.2017, n. 205, which provides that state schools and educational institutions may assign assignments for brief and occasional substitutes, instead of absent administrative and technical assistants, as of the thirtieth day of absence.
