Prime Minister Conte would be thinking about possible changes in the movements between municipalities for Christmas. Here are the hypotheses

First Giuseppe Conte it would have opened a reflection on the opportunity to expand the possibilities of moving between municipalities at Christmas.

This is what ANSA learns from parliamentary sources. The prohibition to leave the municipality in which it is located is foreseen 25 and 26 December and theJanuary 1st.

The reflection opened by Prime Minister Conte, according to the same sources, could lead to changes in the decree law on Covid or yet Government FAQ update, with a broad interpretation of the situations of need that justify the displacement between municipalities.

The dpcm of December 3, 2020 establishes that, despite the prohibitions, from December 21 to January 6 it is still possible to return to one’s residence, domicile or home. What is meant by these three terms?

  • Residence
    Residence is legally defined as the place where the person has his habitual residence. Residency results from personal records and, therefore, can be known accurately and verifiably at all times.
  • Home
    The domicile is legally defined as the place where a person has established the main place of business and interests. The address may be different from the residence.
  • accommodation
    The concept of housing does not have a precise technical-legal definition. For the purposes of applying the dpcm, therefore, the home must be identified as the place where one actually lives, with a certain continuity and stability (therefore for continuous, although limited, periods during the year) or with the usual periodicity and frequency (for example, on certain days of the week for work, study or other needs), but always excluding second homes for holidays.
    To give one more example, people who for work reasons live in a place other than their spouse or partner, but who meet him regularly and periodically at the same address, may move to meet again during the period of December 21 from 2020 to January 6, 2021 in the same house where they usually meet.

Planned sanctions

The Ministry of the Interior has sent a circular to the prefectures specifying the sanctions provided in case of violation of the travel banintroduced with the Dpcm of December 3. The veracity of the self-declarations will be subject to subsequent controls and the proven falsehood of what is declared as a crime. The justification of the reason for the work can also be proven by showing the appropriate documentation provided by the employer (credentials or similar) that demonstrates the declared condition.

All travel bans introduced for the period from December 21, 2020 to January 6, 2021, apply the sanctions provided for in article 4 of decree law no. 19/2020. Non-compliance with containment measures It is sanctioned with the administrative sanction of the payment of a sum of € 400 to € 3,000 ”.

If the breach of the aforementioned measures is caused byuse of a vehicle, the sanctions have increased by up to a third. The reduced payment option also applies to verified violations. In case of repeated violation of the same provision, the duplicate administrative penalty and the auxiliary is applied to the maximum.
