Beginning of the school year: the note on the management of fragile workers in the school sector must be in process, with evident delay. At the moment we are thinking about the draft.

Teachers and Frail ATA Workers

Two cases may occur for teaching staff and temporary ATAs

  • temporary disability established after accepting employment
  • declared brittleness prior to service

In the second case, the orientation of the Ministry is not to allow the signing of the contract regarding the appointment, maintaining the position in the ranking, therefore without penalties.

In the first case, staff must be placed in the office due to illness.

How many days of illness are due

Appoint until June 30 or August 31

Staff hired for the entire school year or until the end of teaching activities (even if designated by the school principal) have the right to retain their position for a period of 9 months in a three-year school year.

In each school year the salary is paid:

  • in full in the first month of absence;
  • 50% in the second and third month (without interruption of the duration of the service);
  • for the rest of the period: retention of the position without allowances and with interruption of seniority for all purposes.

Appointment of temporary substitutes (maximum last day of class)

The staff hired by the manager for temporary substitutions has the right to keep the position for a period not exceeding 30 days a year, with a salary of 50%, within the limits of the duration of the employment relationship (without interruption of seniority in service)

Substitute staff can be fired

What should be noted is that, in this case, substitute personnel in a situation of frailty are “fired” as soon as the maximum sickness limit is exceeded, depending on the type of substitute.
