What can parents do with children in quarantine or for whom face-to-face lessons have been suspended? The Refreshments Decree has perfected the legislation already issued with the August Decree. The Ministry of Education has issued a first note that affects the internal offices, but that can be “studied” to understand how the legislation also applies to teachers and ATA of the school. In fact, there are no exclusions in the legislation.
Decree Law October 28, 2020, n. 137 provides, in art. 22, more incentives for agile work and support for families.
The provision modifies, in particular, art. 21 bis of Decree Law August 14, 2020, n. 104, converted, with modifications, by law October 13, 2020, n. 126, which provides for the possibility of working in an agile way for the parents of a child under 16 years of age who lived together (previously the age limit was set at 14 years), subjected to quarantine by the territorially competent ASL, following verification contact to the interior of the school plesso, nonche ‘in the field of the svolgimento de attivita’ sports base, attivita ‘motoria in structures that palestre, swimming pools, sports centers, sports circles, it was public than private.
Agile work mode can be carried out throughout the quarantine period or even only partially.
Another important novelty is the provision of the possibility of working in an agile way for the parents of a cohabiting child under 16 years of age, in case of suspension of the classroom teaching activity.
Finally, a new amendment to art. 21 bis, paragraph 3, of the decree law August 14, 2020, n. 104.
The provision in question allows, as is well known, “only in the hypothesis in which work performance cannot be carried out in an agile manner”, to refrain from working taking advantage of the extraordinary leave paid at 50% to one of the parents, alternatively to the other . , for all or part of the period corresponding to the duration of the quarantine of the cohabiting child, under the age of fourteen, ordered by the ASL prevention department.
The possibility of availing themselves of the aforementioned license has now been extended, as a result of the aforementioned regulations, also to the cases in which the suspension of teaching activity has been ordered.
