These are those sick parents who are exposed to the contagion that their children can bring home from school. They ask for freedom of choice for students and teachers between Dad (distance learning) and Dip (face-to-face teaching), particularly in situations of personal or family fragility. Currently there is no right to Dad if the father is “fragile”. And each institution does it for itself, based on the decision of the director.

The law entrusts school administrators to grant dad’s requests

Current regulations are reported “which determines a significant difference in the treatment of teachers compared to other public administrations where, in this case, intelligent / agile work is contemplated”. The legislation, it is recalled, “leaves full discretion to school administrators over the acceptance or rejection of requests for distance education for students with fragile relatives, as if it were possible for an administrator to evaluate the opportunity to offer or implement this tool all the times in which there is a weakness declared and / or certified by a doctor “.

The request to cancel the mandatory return to class

They also request the cancellation, pending implementation, subject to suspension of the validity of the dpcm December 3, 2020, in article 1, paragraph 10 letter s, “in the part in which the mandatory return to class is foreseen as of January 7. 2020 for all students of all levels “. And of all the other Decrees of the Prime Minister, the ministerial ordinances and any other provision, even merely executive, of the Decree of the challenged Prime Minister, “since it is detrimental to the interests of the applicants”.

Communicating contagion data for independent analysis

It is also requested that the Ministry of Health provide, through the regional ASL, the data regarding the level of infections in kindergarten, primary, first and second grade schools “, in order to carry out an independent analysis on data objective and timely on the role of the school in the presence of the transmission of infections ”.

There is no adequate level of safety in the classroom for fragile parents.

Frail parents point out in the appeal that with the current epidemiological situation and the discovery of the potentially most contagious “English” viral variant even among the youngest age groups, “there is no effective and adequate level of safety in school classrooms.” . And they point out that there is no safety without updated, complete and nondiscretionary data analyzed by independent studies. There is no security without contact tracing, without testing anyone who has come into contact with positives even if they are asymptomatic, without prompt communication between the health authorities and the school and between the school and the family. And, again, there is no security without a reduction in the number of students per classroom, without effective spacing between desks and without ventilation and air purification systems in the classrooms.
